AN  ACT to amend the general business law, in relation to employee anti-
  trafficking training; and relating to authorizing the establishment of
  a standardized anti-trafficking training program

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The general business law is amended by adding a new section
210 to read as follows:
  S  210.  ANTI-TRAFFICKING  TRAINING.  1.  ANY ESTABLISHMENT WHICH AS A
WHOLE OR PART OF ITS BUSINESS ACTIVITIES OFFERS  LODGING  ACCOMMODATIONS
FOR HIRE TO THE PUBLIC WHERE SUCH LODGING ACCOMMODATIONS ARE PROVIDED IN
A HOTEL AS DEFINED BY SUBDIVISION TWELVE OF SECTION FOUR OF THE MULTIPLE
DWELLING LAW AND ANY ESTABLISHMENT THAT CONSTITUTES A GAMING FACILITY AS
DEFINED  BY  SUBDIVISION  SEVEN  OF  SECTION THIRTEEN HUNDRED ONE OF THE
RACING, PARI-MUTUEL WAGERING AND BREEDING LAW, SHALL REQUIRE ALL EMPLOY-
EES TO UNDERGO AN ANTI-TRAFFICKING TRAINING PROGRAM ESTABLISHED  BY  THE
NEW YORK STATE INTERAGENCY TASK FORCE ON HUMAN TRAFFICKING.
  2.  NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION ONE OF THIS SECTION,
ANY ESTABLISHMENT THAT CURRENTLY REQUIRES EMPLOYEES TO UNDERGO AN  ANTI-
TRAFFICKING  TRAINING  PROGRAM  MAY  SUBMIT SUCH PROGRAM TO THE NEW YORK
STATE INTERAGENCY  TASK  FORCE  ON  HUMAN  TRAFFICKING  FOR  REVIEW  AND
APPROVAL  IF,  IN  THE  JUDGMENT  OF THE AFOREMENTIONED TASK FORCE, SUCH
PROGRAM IS NOT INCONSISTENT WITH THE PRINCIPLES AND STANDARDS  CONTAINED
IN  THE  INTERNATIONAL  LABOR  ORGANIZATION'S HANDBOOK "COMBATING FORCED
LABOUR: A HANDBOOK FOR EMPLOYERS AND BUSINESS".
  S 2. The commissioner of the division of criminal justice services and
the commissioner of the office of temporary  and  disability  assistance
shall   together  establish  a  standardized  anti-trafficking  training
program for employees of hotel  and  gaming  facilities.  Such  training
program  shall address no less than the following issues in a manner not
inconsistent with the principles and standards contained in the interna-
tional labor organization's handbook "Combating forced labour:  a  hand-
book for employers and business":

AN ACT to amend the general business law, in relation to employee  human
  trafficking  recognition  training;  and  relating  to authorizing the
  establishment of a standardized human trafficking recognition training
  program

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The general business law is amended by adding a new section
210 to read as follows:
  S  210. HUMAN-TRAFFICKING RECOGNITION TRAINING. ANY ESTABLISHMENT THAT
CONSTITUTES A GAMING FACILITY AS DEFINED BY SUBDIVISION TWENTY-THREE  OF
SECTION  THIRTEEN  HUNDRED  ONE  OF THE RACING, PARI-MUTUEL WAGERING AND
BREEDING LAW, SHALL REQUIRE ALL EMPLOYEES TO UNDERGO A HUMAN-TRAFFICKING
RECOGNITION TRAINING PROGRAM ESTABLISHED BY  THE  DIVISION  OF  CRIMINAL
JUSTICE  SERVICES  AND THE OFFICE OF TEMPORARY AND DISABILITY ASSISTANCE
IN CONSULTATION WITH THE NEW YORK STATE INTERAGENCY TASK FORCE ON  HUMAN
TRAFFICKING.    HOWEVER,  FOR CLASS III GAMING ESTABLISHMENTS AUTHORIZED
UNDER THE INDIAN GAMING REGULATORY ACT, 25 U.S.C. S 2701, ET  SEQ.,  THE
GAMING  COMMISSION  SHALL MAKE AVAILABLE, UPON REQUEST, SUCH HUMAN-TRAF-
FICKING RECOGNITION TRAINING PROGRAM.
  S 2.  In consultation with the New  York  Interagency  Task  Force  on
Human  Trafficking, the commissioner of the division of criminal justice
services and the commissioner of the office of temporary and  disability
assistance  shall  together  establish  a standardized human-trafficking
recognition training program for employees  of  gaming  facilities.  The
commissioners may use federal, state, and non-profit organization sourc-
es  provided  that  such training program shall address no less than the
following issues:
  (a) The nature of human trafficking;
  (b) How human trafficking is defined in law;
  (c) How to identify victims of human trafficking;
