AN ACT to amend the general municipal law, in relation to requiring  the
  Onondaga  county industrial development agency to obtain approval from
  the local municipalities before granting financial assistance to enti-
  ties within those municipalities

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  895  of  the general municipal law is amended by
adding a new subdivision 3 to read as follows:
  3.  NOTWITHSTANDING THE POWERS AND DUTIES NOW OR  HEREAFTER  CONFERRED
BY  TITLE  ONE  OF THIS ARTICLE, THE AGENCY SHALL OBTAIN THE APPROVAL OF
THE GOVERNING BODY WITHIN THE BOUNDARIES OF THE  LOCAL  MUNICIPALITY  OR
AFFECTED  TAX  JURISDICTION  BEFORE  GRANTING  ANY FINANCIAL ASSISTANCE,
INCLUDING, BUT NOT LIMITED TO, PAYMENTS IN LIEU OF  TAX  AGREEMENTS  AND
THE ISSUANCE OF BONDS AND NOTES, TO ANY PERSON, PARTNERSHIP, COOPERATION
OR  OTHER  LEGAL  ENTITY WITHIN THE TERRITORIAL BOUNDARY OF THE AFFECTED
TAX JURISDICTION.  SUCH APPROVAL SHALL BE SERVED UPON THE  SECRETARY  OF
THE  ONONDAGA  COUNTY  INDUSTRIAL  DEVELOPMENTAL AGENCY IN THE FORM OF A
CERTIFIED ORDINANCE ADOPTED BY THE GOVERNING BODY. SUCH ORDINANCE  SHALL
BE  SERVED WITHIN FORTY-FIVE DAYS OF THE GOVERNING BODY'S RECEIPT OF THE
ONONDAGA COUNTY INDUSTRIAL DEVELOPMENT AGENCY  PROPOSAL  TO  GRANT  SUCH
FINANCIAL  ASSISTANCE. THE GOVERNING BODY OF SUCH TAX AFFECTED JURISDIC-
TION SHALL HAVE NINETY DAYS TO APPROVE OR DENY SUCH REQUEST.
  S 2. This act shall take effect immediately.
