BILL NUMBER:A9898 TITLE OF BILL: An act to amend chapter 491 of the laws of 1995 amending the workers' compensation law relating to permitting the establishment of an alternative dispute resolution system to resolve workers' compen- sation claims through collective bargaining agreements, in relation to making such provisions permanent PURPOSE: Makes permanent the alternative dispute resolution system to resolve workers' compensation claims through collective bargaining agreements. SUMMARY OF PROVISIONS: Section one permanently extends the alternative dispute resolution system for certain workers' compensation claims. EXISTING LAW: Present law expires on Dec. 31, 2010. JUSTIFICATION: The alternative dispute resolution system for the resol- ution for certain construction industry claims has been successful for employers and workers. LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS: None. EFFECTIVE DATE: Immediate.

MILLER -- read once and referred to the Committee on Labor AN ACT to amend chapter 491 of the laws of 1995 amending the workers' compensation law relating to permitting the establishment of an alter- native dispute resolution system to resolve workers' compensation claims through collective bargaining agreements, in relation to making such provisions permanent THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 4 of chapter 491 of the laws of 1995 amending the workers' compensation law relating to permitting the establishment of an alternative dispute resolution system to resolve workers' compensation claims through collective bargaining agreements, as amended by chapter 649 of the laws of 2005, is amended to read as follows: S 4. This act shall take effect immediately[, provided, however, that the provisions of subdivision 2-c of section 25 of the workers' compen- sation law, as added by section one of this act, shall expire and be deemed repealed on and after December 31, 2010]. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD15611-02-0
