AN  ACT to amend the education law, in relation to directing the commis-
  sioner of education to  conduct  an  audit  and  report  on  statewide
  compliance with state instructional regulations for arts education

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The education law is amended by adding a new section 816 to
read as follows:
  S 816. ARTS INSTRUCTION COMPLIANCE.   1.  THE  COMMISSIONER  SHALL  BE
AUTHORIZED AND REQUIRED TO COLLECT THE NECESSARY DATA AND INFORMATION TO
ASSESS  COMPLIANCE WITH STATE EDUCATION REGULATIONS FOR ARTS INSTRUCTION
AT ALL SCHOOLS THROUGHOUT THE STATE ONCE EVERY FIVE YEARS.  THE BOARD OF
EDUCATION OR TRUSTEES OF ALL SCHOOL DISTRICTS SHALL COMPLY WITH REQUESTS
BY THE DEPARTMENT FOR SUCH INFORMATION AS  IS  DEEMED  RELEVANT  BY  THE
DEPARTMENT.
  2.  THE  INITIAL ASSESSMENT REQUIRED BY THE PROVISIONS OF THIS SECTION
SHALL BE CONDUCTED AND REPORTED TO THE LEGISLATURE  AND  THE  PUBLIC  BY
JUNE,  TWO THOUSAND FOURTEEN FOR THE TWO THOUSAND THIRTEEN--TWO THOUSAND
FOURTEEN SCHOOL YEAR AND EVERY FIVE YEARS THEREAFTER.
  3. ONCE A DISTRICT HAS BEEN FOUND  TO  BE  COMPLIANT  WITH  THE  STATE
EDUCATION  REGULATIONS  FOR ARTS INSTRUCTION, THE COMMISSIONER SHALL NOT
BE REQUIRED TO ASSESS OR EVALUATE THAT DISTRICT'S LEVEL OF COMPLIANCE AS
PROVIDED IN SUBDIVISION ONE OF THIS SECTION OR  TO  INCLUDE  INFORMATION
CONCERNING  THE  DISTRICT'S  COMPLIANCE WITH STATE EDUCATION REGULATIONS
FOR ARTS INSTRUCTION IN THE REPORT TO THE LEGISLATURE AND THE PUBLIC  AS
PROVIDED IN SUBDIVISION TWO OF THIS SECTION.
  S 2. This act shall take effect immediately.

AN  ACT to amend the education law, in relation to directing the commis-
  sioner of education to  conduct  an  audit  and  report  on  statewide
  compliance with state instructional regulations for arts education and
  to  establish  a  remediation  process  for schools found to be out of
  compliance

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The education law is amended by adding a new section 816 to
read as follows:
  S  816.  STATEWIDE  AUDIT  OF  COMPLIANCE.   THE COMMISSIONER SHALL BE
AUTHORIZED AND REQUIRED TO CONDUCT A STATEWIDE AUDIT OF COMPLIANCE  WITH
STATE EDUCATION REGULATIONS FOR ARTS INSTRUCTION. THE BOARD OF EDUCATION
OR  TRUSTEES  OF  ALL SCHOOL DISTRICTS SHALL COMPLY WITH REQUESTS BY THE
DEPARTMENT FOR SUCH INFORMATION DEEMED RELEVANT BY THE DEPARTMENT.  SUCH
ASSESSMENT  SHALL  BE  CONDUCTED AND REPORTED TO THE LEGISLATURE AND THE
PUBLIC BY JUNE, TWO THOUSAND FOURTEEN FOR THE TWO THOUSAND THIRTEEN--TWO
THOUSAND FOURTEEN SCHOOL YEAR AND EVERY FIVE YEARS THEREAFTER.
  S 2. Section 305 of the education law  is  amended  by  adding  a  new
subdivision 43 to read as follows:
  43. HE OR SHE SHALL REQUIRE THE BOARD OF EDUCATION OR TRUSTEES OF EACH
SCHOOL  DISTRICT  THAT  IS  FOUND  TO  BE  OUT  OF COMPLIANCE WITH STATE
INSTRUCTIONAL REGULATIONS FOR ARTS EDUCATION  TO  DEVELOP  A  CORRECTIVE
ACTION  PLAN  THAT  DESCRIBES    STEPS  TO  ENSURE COMPLIANCE WITH STATE
REQUIREMENTS WITH A TIMETABLE FOR IMPLEMENTATION OF STEPS WITHIN  TWELVE
MONTHS  OF  THE  AUDIT. THE COMMISSIONER SHALL BE REQUIRED TO REVIEW AND
