BILL NUMBER:S1035 TITLE OF BILL: An act to create a temporary state commission to study and make recommendations concerning the incidence of asthma in the borough of the Bronx in New York city PURPOSE OR GENERAL IDEA OF BILL: To create a state commission to study the incidence of asthma in Bronx County, the county with the highest incidence of asthma in the state of New York. SUMMARY OF SPECIFIC PROVISIONS: Section 1 creates a temporary state commission to study the incidence of asthma in Bronx county. Section 2 requires the commission to consist of 11 members: 5 appointed by the Governor with two from the Departments of Health and Environmental Conservation; 2 members appointed by the temporary president of the senate and one by the minority leader; and, two appointed by the speaker of the assembly and one by the minority leader. All members of the commission must be residents of the city of New York, expect for the two appointees from DOH and DEC. Section 3 states there is no compensation for membership on the commission, but members are allowed actual and necessary expenses for performance of their official duties. Section 4 states the commission can meet wherever the committee deems necessary and shall hold public hearings quarterly with all the powers of a legislative commission pursuant to the legislative law. Section 5 states the commission shall make a report of its findings to the governor and legislature. JUSTIFICATION: Legislators and policy makers need the input and recommendations of the commission to immediately address the high incidence of asthma throughout the Bronx. The creation of the commission is a step towards addressing this dire situation as well as making recommendations to eradicate the high incidence of asthma. AN ACT to create a temporary state commission to study and make recom-
mendations concerning the incidence of asthma in the borough of the
Bronx in New York city
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. A temporary state commission is hereby created to study and
make recommendations relating to the incidence of asthma in the borough
of the Bronx in New York, which has the highest incidence of asthma in
the state. The commission will place particular emphasis on youth in
communities with an unemployment rate exceeding one hundred twenty-five
percent of the statewide level.
S 2. The commission shall consist of eleven members to be appointed as
follows: five shall be appointed by the governor; two shall be appointed
by the temporary president of the senate and one by the minority leader
of the senate; and two shall be appointed by the speaker of the assembly
and one by the minority leader of the assembly. The members of the
commission shall serve at the pleasure of the official making the
appointment of such member. Of the five members appointed by the gover-
nor, one shall be from the department of health and one shall be from
the department of environmental conservation. The remaining nine members
of the commission must reside in a city with a population of one million
or more. Vacancies in the membership of the commission shall be filled
in the manner provided for original appointments. Membership on the
commission shall not constitute a public office. A chairperson and vice-
chairperson of the commission shall be elected by a majority of its
members, all members being present.

S 3. The members of the commission shall receive no compensation for
their services, but shall be allowed their actual and necessary expenses
incurred in the performance of their duties pursuant to this act.
S 4. The commission may meet within and without the state, shall hold
at least one public hearing each quarter, and shall have all the powers
of a legislative committee pursuant to the legislative law.
S 5. The commission shall make a report of its findings and make any
recommendations it may deem necessary and appropriate to the governor,
the temporary president of the senate and the speaker of the assembly no
later than one year after the effective date of this act.
S 6. This act shall take effect immediately.
