BILL NUMBER:S1103A TITLE OF BILL: An act to amend the public authorities law, in relation to the maintenance of a database on intellectual property PURPOSE OR GENERAL IDEA OF BILL: To establish a database of intellectual property in the New York State Foundation for Science, Technology, and Innovation (NYSTAR). SUMMARY OF SPECIFIC PROVISIONS: Amends subparagraphs (x) and (xi) of paragraph (b) of subdivision 2 of section 3155 of the public authorities law to include an update on the status of such database in the annual report of the New York State Foundation for Science, Technology, and Innovation. Adds a new Subdivision 3 of section 3155 of the public authorities law to include the operation and maintenance of a public, interactive database of all intellectual property generated by state employees or developed through state-funded research. JUSTIFICATION: Countless products and processes are developed in part with funds invested by the State, but often these do not get beyond the development stage. This intellectual property should be catalogued and made public so that individuals and/or companies interested in commercializing any of the property have a comprehensive and current database where all such items and appropriate contacts are listed. AN ACT to amend the public authorities law, in relation to the mainte-
nance of a database on intellectual property
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subparagraphs (x) and (xi) of paragraph (b) of subdivision
2 of section 3155 of the public authorities law, as amended by section 4
of part C of chapter 63 of the laws of 2005, are amended to read as
follows:
(x) number of patents awarded to the college or university as a direct
result of research related to the award and income generated from the
licensure or sale of such intellectual property; [and]
(xi) CURRENT STATUS OF THE INTERACTIVE DATABASE OF INTELLECTUAL PROP-
ERTY CREATED PURSUANT TO SUBDIVISION THREE OF THIS SECTION; AND
(XII) any other information deemed appropriate by the director.
S 2. Section 3155 of the public authorities law is amended by adding
a new subdivision 3 to read as follows:
3. THE FOUNDATION SHALL ALSO OPERATE AND MAINTAIN A PUBLIC, INTERAC-
TIVE DATABASE OF ALL INTELLECTUAL PROPERTY GENERATED BY STATE EMPLOYEES
OR DEVELOPED THROUGH STATE-FUNDED RESEARCH WHICH SHALL INCLUDE, AT A
MINIMUM, A BRIEF DESCRIPTION OF THE INTELLECTUAL PROPERTY AND UP-TO-DATE
CONTACT INFORMATION FOR EACH ITEM;
S 3. This act shall take effect immediately.
