BILL NUMBER:S1115

TITLE OF BILL: An act to amend the environmental conservation law, in relation to exemptions from requirements for hunting, big game, fishing and trapping licenses

PURPOSE: To allow active service members stationed outside of New York State to take fish as if they held a fishing license.

SUMMARY OF PROVISIONS: Section 11-0707 of the environmental conservation law is amended by adding that a member of the United States armed forces in active service, who is not stationed within the state and has not been here longer than thirty days on leave or furlough, may take fish as if he or she held a fishing license.

JUSTIFICATION: Currently, an active service member of the United States armed forces that is visiting family in New York State while on leave or furlough cannot fish without first obtaining an out of state fishing license. Active service members are limited in the time they get to spend on leave, and even further limited by licensing requirements required to enjoy activities while visiting family within New York State. This bill will allow these active service members, who are in the state for no longer than thirty days, to take fish as if they held a fishing license. Further, this bill provides our active service men and women with an opportunity to enjoy fishing in times when they are not stationed ready to defend our country.

Section 11-0707 of the environmental conservation law is amended by adding a new subdivision 10 to read as follows: 10. A MEMBER OF THE UNITED STATES ARMED FORCES IN ACTIVE SERVICE WHO IS NOT STATIONED WITHIN THE STATE AND HAS NOT BEEN HEREIN LONGER THAN THIRTY DAYS ON LEAVE OR FURLOUGH MAY TAKE FISH AS IF HE OR SHE HELD A FISHING LICENSE. S 2. This act shall take effect immediately.
