BILL NUMBER:S1369 TITLE OF BILL: An act to amend the general business law, in relation to requiring every keeper of a hotel or motel or inn to make condoms available for sale to guests PURPOSE: To prevent the spread of sexually transmitted diseases by requiring hotels, motels and inns to make available condoms for sale. SUMMARY OF PROVISIONS: Adds a new section 204-b to the General Business Law for sale of condoms. Provides that owners of hotels, motels or inns shall have condoms or similar prophylactics available for sale in the registration office. JUSTIFICATION: Over the past few years, this state has seen an enormous increase in then incidence of AIDS. Rendering laws to prevent AIDS should, therefore, be of primary concern. Medical studies have shown that proper use of condoms will minimize the risk of spreading the AIDS virus. This bill is an attempt to access such prophylactics in public accommodations. AN ACT to amend the general business law, in relation to requiring every keeper of a hotel or motel or inn to make condoms available for sale to guests THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. The general business law is amended by adding a new section 204-b to read as follows:
S 204-B. SALE OF CONDOMS. EVERY KEEPER OF A HOTEL OR MOTEL OR INN SHALL, IN THE REGISTRATION OFFICE, SELL OR OFFER FOR SALE TO REGISTERED GUESTS OF SUCH HOTEL OR MOTEL OR INN CONDOMS OR SIMILAR PROPHYLACTIC DEVICES DESIGNED TO PREVENT CONCEPTION OR VENEREAL INFECTION DURING SEXUAL INTERCOURSE.
