BILL NUMBER:S1439 TITLE OF BILL: An act to establish a task force on food, nutrition and physical education to investigate and establish appropriate and healthy meal plans and physical education standards for New York state schools; making an appropriation therefor and providing for the repeal of such provisions upon expiration thereof PURPOSE OR GENERAL IDEA OF BILL: To establish a task force on food, nutrition and physical education to investigate and establish appropriate and healthy meal plans and physical education standards for New York city schools; making an appropriation therefore and providing for the repeal of such provisions upon expiration thereof. SUMMARY OF SPECIFIC PROVISIONS: The primary duties of the task force will be to investigate and establish appropriate and healthy meal plans and physical education standards for New York City Schools. The task force shall consist of 15 members as follows: Chaired by Commissioner of Education or designee * (5) members appointed by the commissioner of education; * (2) members shall be appointed upon recommendation of the Chancellor of City school district of New York; * (3) members shall be appointed upon recommendation of the Governor; * (3) members appointed upon the recommendation of the Speaker of the Assembly; * (2) members appointed upon the recommendation of the temporary president of the Senate; and * Commissioner of Education may invite appropriate ad hoc representatives from other state and/or local agencies to serve on the task force. The task force shall report its findings, conclusions and recommendations to the governor, temporary president of the senate and the speaker of the assembly by September 1, 2013. JUSTIFICATION: This legislation will help to establish a healthy meal plan for our school children and ensure that they are receiving proper nutrition. This healthy meal plan is to include that of children with specific dietary needs also. In addition, the physical education portion is to investigate and ensure that the children receive an adequate physical endurance test once a year. EFFECTIVE DATE: Immediately and remain in full force and effect until September 1, 2015 when upon such date the provisions of this act shall expire and be deemed repealed.

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. The commissioner of health is hereby directed to create a task force on food, nutrition and physical education to investigate and establish appropriate and healthy meal plans and physical education standards for New York state schools.
S 2. The task force shall consist of 15 members and shall be chaired by the commissioner of health or his designee. Five members shall be appointed by the commissioner of health; two members shall be appointed upon the recommendation of the commissioner of education; three members shall be appointed upon the recommendation of the governor; two members shall be appointed upon the recommendation of the speaker of the assem bly; and two members shall be appointed upon the recommendation of the temporary president of the senate. The commissioner of health may invite appropriate ad hoc representatives from other state and/or local agen cies to serve on the task force. Vacancies on the task force shall be filled in the manner provided for original appointments.
S 3. The task force shall report its findings, conclusions and recom mendations to the governor, temporary president of the senate and the speaker of the assembly by September 1, 2015. S 4. The sum of twenty-five thousand dollars ($25,000), or so much thereof as may be necessary, is hereby appropriated to the department of health from any moneys in the state treasury in the general fund to the credit of the state purposes account not otherwise appropriated, for its expenses in carrying out the provisions of this act.
S 5. This act shall take effect immediately and shall remain in full force and effect until September 1, 2015 when upon such date the provisions of this act shall expire and be deemed repealed.
