BILL NUMBER:S1483 TITLE OF BILL: An act to authorize the village of Oyster Bay Cove, town of Oyster Bay, county of Nassau to expend trust funds for the construction of a village hall and police headquarters PURPOSE: The bill authorizes the Village of Oyster Bay Cove to expend trust funds from the recreation site and improvement fund for the construction of a village hall and police headquarters. SUMMARY OF PROVISIONS: Authorizes the Village of Oyster Bay Cove to expend certain funds from the recreation, site and improvement fund for the construction of a village hall and police headquarters on Route 25A. The expenditure will only be made following a majority vote of the Board of Trustees of the Village of Oyster Bay Cove and will not exceed $955,851. JUSTIFICATION: The Village of Oyster Bay Cove seeks to utilize funds from the recreation, site and improvement fund for the construction of a village hall and police headquarters. The Village seeks access to these funds in order to provide for the general safety and welfare of the Village residents and the long-term sustainability and future of the Village. The current Village Hall is an outdated leased trailer and does not adequately meet the needs of the Village residents. The separate Police Headquarters is almost beyond it useful life and requires a significant upgrade. Section 7-730 of the New York State Village Law requires legislative approval to expend funds not used exclusively for recreational uses. LEGISLATIVE HISTORY: S.4254 of 2011/12. FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to authorize the village of Oyster Bay Cove, town of Oyster Bay,
county of Nassau to expend trust funds for the construction of a
village hall and police headquarters
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding any other provision of law, the village of
Oyster Bay Cove, town of Oyster Bay, county of Nassau is hereby author-
ized to expend trust funds from the recreation site and improvement fund
of such village for the purpose of construction of a Village Hall and
Police Headquarters. Such expenditure of trust funds shall be made by
majority vote of the board of trustees of the village of Oyster Bay Cove
and shall not exceed a total of $955,851.
S 2. This act shall take effect immediately.
