BILL NUMBER: S169 TITLE OF BILL : An act in relation to requiring state agencies to issue a report to the civil service department and the legislature regarding an analysis of the feasibility of alternative work schedules within such departments PURPOSE : This bill would require state agencies to provide a report to the civil service department and the legislature about different methods by which flexible work schedules can be enhanced in state government. SUMMARY OF PROVISIONS : Section I establishes the procedure by which state agencies will submit reports detailing the feasibility of programs that permit flexible working arrangements within such agencies. Section II sets forth the effective date. JUSTIFICATION : Vermont recently passed legislation that gives employees the right to request flexible working arrangements. Under New York State law flexible working arrangements are not required. As the demand for

SQUADRON -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT in relation to requiring state agencies to issue a report to the civil service department and the legislature regarding an analysis of the feasibility of alternative work schedules within such departments THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The head of every department and agency within the state shall, on or before the first day of each March next succeeding the date on which this act shall have taken effect, issue or cause to be issued to the speaker of the assembly, the temporary president of the senate and the president of the civil service commission a report detailing the feasibility of programs permitting alternative work schedules and flexi- ble work hours within such department or agency. Such report shall pres- ent an analysis of how programs for alternative work schedules and flexible work hours for employees could be implemented in such depart- ment or agency including, but not limited to, how many positions could be incorporated into such programs and the advantages and disadvantages of such programs. However, no plan regarding alternative work schedules or flexible work hours shall be implemented and cannot be enforced with regard to employees represented by a bargaining unit unless and until such plan is implemented through a collective bargaining agreement.
