AN ACT to amend the labor law, in relation to asbestos projects

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 2 of section 904 of the labor law is amended by
adding a new closing paragraph to read as follows:
  EXCEPT  THAT IN THE CASE OF A CONTRACTOR WHO IS LICENSED AND OTHERWISE
COMPLIES WITH THE CERTIFICATION REQUIREMENTS  OF  THIS  ARTICLE  AND  IS
EMPLOYED  BY  A  MUNICIPALITY  WHICH IS FUNDING A PORTION OF AN ASBESTOS
PROJECT WITH MONIES FROM THE RESTORE NEW YORK'S  COMMUNITIES  INITIATIVE
PURSUANT  TO  SECTION SIXTEEN-N OF THE URBAN DEVELOPMENT CORPORATION ACT
SUCH CONTRACTOR SHALL NOT BE REQUIRED TO PAY  THE  PROJECT  NOTIFICATION
FEE.
  S 2. This act shall take effect immediately.
