BILL NUMBER:S185 TITLE OF BILL: An act to amend the education law, in relation to authorizing vocational education and extension boards to permit students who receive home instruction to participate in vocational education courses SUMMARY OF PROVISIONS: Section 1 amends section 1102 of the education law by adding a new subdivision (16). Section 2 provides for an effective date. PURPOSE AND JUSTIFICATION: Currently, New York State law states that home schooled students are not entitled to participate in vocational education programs. Students Parents/guardians are required to pay local school taxes yet their children are not entitled to the basic benefits their school districts provide. It is unfair to punish these students whose parents have made a decision to be more actively involved in their child's education. The goal of this legislation is to afford to home schooled students the same opportunities as students who attend public schools so that they may also have a well-rounded educational experience. PRIOR LEGISLATIVE HISTORY: S.6097/A.8816 of 2009-2010; Referred to Education. FISCAL IMPLICATIONS: To be determined. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend the education law, in relation to authorizing vocational education and extension boards to permit students who receive home instruction to participate in vocational education courses
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1.
Section 1102 of the education law is amended by adding a new subdivision 16 to read as follows:
16. IT SHALL PROVIDE VOCATIONAL EDUCATION COURSES TO STUDENTS RESIDING IN THE COUNTY WHO RECEIVE HOME INSTRUCTION, AT THE REQUEST OF THE PARENT, GUARDIAN OR PERSONS HAVING CUSTODY OF SUCH STUDENT. SUCH A REQUEST SHALL BE FILED WITH THE VOCATIONAL EDUCATION AND EXTENSION BOARD OF THE COUNTY IN WHICH THE PARENT, GUARDIAN OR PERSONS LEGALLY HAVING CUSTODY OF THE PUPIL RESIDES ON OR BEFORE THE FIRST DAY OF JUNE PRECED ING THE SCHOOL YEAR FOR WHICH THE REQUEST IS MADE.
