BILL NUMBER:S1883 TITLE OF BILL: An act to amend the state finance law, in relation to the monies of the spinal cord injury research trust fund PURPOSE OR GENERAL IDEA OF BILL: To establish a minimum annual level of funding for the Spinal Cord Injury Research Trust Fund. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Amends subdivision 2 of section 99-f of the State Finance Law, to require that five and six-tenths percent (5.6%) of the revenue New York State collects from the mandatory surcharges imposed on motor vehicle violations pursuant to subdivision one of section eighteen hundred nine of the vehicle and traffic law be allocated to the Spinal Cord Injury Research Trust Fund. Section 2: Effective date. JUSTIFICATION: Chapter 338 of the laws of 1998 created the Spinal Cord Injury Research Trust Fund with the intent that up to $8.5 million per year would be allocated to it out of the mandatory surcharge imposed by the state on motor vehicle moving violations. The Spinal Cord Injury Research Board would then distribute grants to worthwhile research projects related to spinal cord injuries. However, in recent years it has been funded at minimum with no money allocated for new grants. This legislation would establish a minimum annual level of funding for the Spinal Cord Injury Research Trust Fund. AN ACT to amend the state finance law, in relation to the monies of the
spinal cord injury research trust fund
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 2 of section 99-f of the state finance law, as
amended by chapter 612 of the laws of 1999, is amended to read as
follows:
2. The fund shall consist of all monies appropriated for its purpose,
all monies required by this section or any other provision of law to be
paid into or credited to such fund, and FIVE AND SIX-TENTHS PER CENTUM
OF monies COLLECTED BY THE MANDATORY SURCHARGES IMPOSED PURSUANT TO
SUBDIVISION ONE OF SECTION EIGHTEEN HUNDRED NINE OF THE VEHICLE AND
TRAFFIC LAW in an amount not to exceed eight million five hundred thou-
sand dollars [collected by the mandatory surcharges imposed pursuant to
subdivision one of section eighteen hundred nine of the vehicle and
traffic law]. Nothing contained herein shall prevent the department of
health from receiving grants, gifts or bequests for the purposes of the
fund as defined in this section and depositing them into the fund
according to law.
S 2. This act shall take effect immediately.
