BILL NUMBER:S2038 TITLE OF BILL: An act to amend the social services law, in relation to state reimbursement to certain day care centers PURPOSE: To require the State provide reimbursement to days care providers within 30 days of the receipt of an invoice for services. SUMMARY OF PROVISIONS: Paragraph (b) of subdivision 2 of section 410-c of the social services law, as added by chapter 1014 of the laws of 1969 and such section as renumbered by chapter 640 of the laws of 1971, is amended to require payment within thirty days of an invoice being submitted to the State. JUSTIFICATION: This legislation would allow for the prompt payment of expenditures made by counties, cities, and towns for day care and its administration. Currently, the State is under no set time limit to reim- burse these costs. The localities are forced to payout of pocket for their costs related to providing day care services, with no way of know- ing when they might be reimbursed. This proposal would set forth a timeline for reimbursements and allows the localities a greater ability to plan and manage their finances related to day care services. AN ACT to amend the social services law, in relation to state reimburse-
ment to certain day care centers
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Paragraph (b) of subdivision 2 of section 410-c of the
social services law, as added by chapter 1014 of the laws of 1969 and
such section as renumbered by chapter 640 of the laws of 1971, is
amended to read as follows:
(b) When certified by the department, state reimbursement shall be
paid from the state treasury upon the audit and warrant of the comp-
troller out of funds made available therefor WITHIN THIRTY DAYS OF AN
INVOICE BEING SUBMITTED TO THE STATE.
S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law; provided, however, that effective immediate-
ly, the addition, amendment and/or repeal of any rule or regulation
necessary for the implementation of this act on its effective date are
authorized and directed to be made and completed on or before such
effective date.
