TITLE OF BILL: An act to amend the executive law, in relation to adding the Scajaquada Creek to the definition of inland waterways

PURPOSE OR GENERAL IDEA OF TEE BILL: This bill will have the Scajaquada Creek included as one of the states major rivers and to be considered a inland waterways.

SUMMARY OF SPECIFIC PROVISIONS: This bill will amend paragraph (c) of subdivision 4 of section 911 of the executive law.

JUSTIFICATION: The Scajaquada Creek plays an important role in Erie County as it is part of the watershed and enters the Niagara River. It was utilized as a portion of the Erie Canal system and currently provides some of the fresh, potable water for the members of Erie County. Being classified as inland waterway would help to provide federal funds to restore and protect the river.

EFFECTIVE DATE: This act shall take effect immediately.

GRISANTI -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to adding the Scajaquada Creek to the definition of inland waterways THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 4 of section 911 of the execu- tive law, as amended by chapter 133 of the laws of 2012, is amended to read as follows: (c) the state's major creeks comprised of the Bushkill, Cattaraugus, Cincinnati, East Kill, Esopus (including upper and lower branches), Fish (including east and west branches), Gooseberry, Little Sandy, Onondaga, Sandy, Schoharie, South Sandy, Oatka [and], Tonawanda [and], West Kill, AND SCAJAQUADA; S 2. This act shall take effect immediately.
