BILL NUMBER:S2088

TITLE OF BILL: An act to amend the public authorities law, in relation to one-way or round trip tickets purchased for use on the Long Island Rail Road and the Metro-North Commuter Railroad Company

PURPOSE OR GENERAL IDEA OF BILL: To eliminate the cost of mandated surcharges for the cancellation of one-way or round trip Long Island Rail Road and Metro-North Commuter Railroad Company tickets within six months of their original purchase.

SUMMARY OF SPECIFIC PROVISIONS: Creates Section 1266-j of the public authorities law; requiring the Metropolitan Transit Authority to extend the validity of one-way or round trip Long Island Railroad and Metro-North Railroad tickets to six months from the date of purchase and to reimburse one hundred percent (100%) of the purchase price for unused one-way or round Long Island Rail Road and Metro-North Commuter Railroad Company tickets returned within six months of the date of purchase and prohibiting the assessment of any surcharge or processing fee for the returned ticket.

JUSTIFICATION: On December 30, 2010, the Metropolitan Transit Authority (MIA) Board adopted a new refund policy for tickets purchased for the Long Island Rail Road (LIRR) and Metro-North Commuter Railroad Company. The recently instituted policy invalidates Unused One Nay and Round Trip tickets within two weeks of the purchase date. For a full refund, any unused tickets must be returned within 30 days of the purchase date. Prior to this policy's enactment, LIRR and Metro-North tickets had been valid for up to six months.

This legislation will prolong the use of tickets for a reasonable amount of time.
