BILL NUMBER:S2098 TITLE OF BILL: An act to amend the penal law, in relation to unlawful manufacture, production or reproduction of a vehicle identification number with intent to defraud PURPOSE: The purpose of this bill is to impose greater penalties for the fraudulent production of vehicle identification number (VIN). SUMMARY OF PROVISIONS: Adds a new subdivision (4) to section 170.65 of the penal law regarding the unlawful manufacture, production or reproduction of a vehicle identification number (VIN) with intent to defraud. A violation of section would constitute a class E felony, EXISTING LAW: Section 170.65 of the penal law. JUSTIFICATION: This will add another tool in the fight against the auto theft and fraud. The sophistication of equipment today in reproducing VIN's warrants additional penalties to provide incentives against such activities. GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to unlawful manufacture, production or reproduction of a vehicle identification number with intent to defraud THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 170.65 of the penal law is amended by adding a new subdivision 4 to read as follows: (4) HE OR SHE, WITH INTENT TO DEFRAUD, KNOWINGLY MANUFACTURES, PRODUC- ES OR REPRODUCES A VEHICLE IDENTIFICATION NUMBER, ETCHING, LABEL, STICK- ER, PLATE, OR OTHER TANGIBLE MEANS OF IDENTIFYING A SPECIFIC MOTOR VEHI- CLE, WHICH WAS NOT MANUFACTURED, PRODUCED OR REPRODUCED IN ACCORDANCE WITH THE RULES AND REGULATIONS PROMULGATED BY THE UNITED STATES NATIONAL HIGHWAY SAFETY ADMINISTRATION AND/OR IN ACCORDANCE WITH THE PROVISIONS OF THE STATE VEHICLE AND TRAFFIC LAW. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
