2011-S210 (ACTIVE) - Summary

Provides that fifty per centum of all additional power made available from improvements and upgrades at the Niagara project shall be deemed "additional expansion power" and shall be allocated to businesses located within the state within thirty miles of the Niagara project.

AN  ACT to amend the public authorities law, in relation to improvements
  and upgrades at the Niagara project

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public  authorities  law  is amended by adding a new
section 1005-b to read as follows:
  S 1005-B. IMPROVEMENTS  AND  UPGRADES  AT  THE  NIAGARA  PROJECT.  THE
AUTHORITY  IS  DIRECTED TO SUBSTANTIALLY IMPROVE AND UPGRADE THE NIAGARA
PROJECT'S POWER PRODUCING CAPACITY.
  NOTWITHSTANDING ANY PROVISIONS OF LAW TO THE CONTRARY BUT  SUBJECT  TO
THE  TERMS  AND  CONDITIONS  OF  FEDERAL  ENERGY  REGULATORY  COMMISSION
LICENSES, FIFTY PER CENTUM OF ALL ADDITIONAL POWER MADE  AVAILABLE  FROM
IMPROVEMENTS  AND UPGRADES AT THE NIAGARA PROJECT SHALL BE DEEMED "ADDI-
TIONAL EXPANSION POWER" AND SHALL BE  ALLOCATED  TO  BUSINESSES  LOCATED
WITHIN  THE STATE THAT ARE WITHIN THIRTY MILES OF THE NIAGARA PROJECT IN
ACCORDANCE WITH THE PROVISIONS OF SECTION  ONE  THOUSAND  FIVE  OF  THIS
TITLE.
  S 2. This act shall take effect immediately.
