BILL NUMBER:S2140 TITLE OF BILL: An act to amend the education law, in relation to BOCES technology PURPOSE: To allow school districts to leverage economies of scale by allowing BOCES to purchase telecommunications equipment on behalf of their component districts. SUMMARY OF PROVISIONS: Section 1: Adds a new paragraph to section 1950(4) of the education law. Section 2: Sets forth an immediate effective date. JUSTIFICATION: Recent years have confronted school districts with unprecedented fiscal challenges. While the economic outlook for the state is steadily improving, it is a legislative priority to provide as much flexibility as possible to school districts to enable them to provide the high quality education we have come to expect for our students. While there are many requirements imposed on school districts that provide educational value, others continue to constrain the creativity of a district to provide services to students and relief to taxpayers.

FLANAGAN -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to BOCES technology THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 1950 of the education law is amended by adding a new paragraph oo to read as follows: OO. AT THE REQUEST OF ONE OR MORE SCHOOL DISTRICTS, CONTRACT FOR THE PROCUREMENT OF TELECOMMUNICATIONS EQUIPMENT ON BEHALF OF SUCH SCHOOL DISTRICTS, SUBJECT TO THE REQUIREMENTS OF SECTION ONE HUNDRED THREE AND SECTION ONE HUNDRED FOUR-B OF THE GENERAL MUNICIPAL LAW, PROVIDED THAT THE COSTS OF SUCH CONTRACTS SHALL BE ELIGIBLE FOR AID PURSUANT TO SUBDI- VISION FIVE OF THIS SECTION IF APPROVED BY THE COMMISSIONER AS AN AIDA- BLE SHARED SERVICE UPON REQUEST OF TWO OR MORE COMPONENT SCHOOL DISTRICTS.
