BILL NUMBER:S2148 TITLE OF BILL: An act to amend the elder law, in relation to authorizing certain county operated NY Connects: Choices for Long Term Care programs to participate in a uniform assessment demonstration program PURPOSE OR GENERAL IDEA OF BILL: Creates a uniform assessment demonstration program within the state office for the aging. SUMMARY OF SPECIFIC PROVISIONS: Adds a new subdivision to the elder law, which requires the director of the state office for the aging to select one or more county operators of the NY Connect program to participate in a uniform assessment demonstration program for determining the appropriate level of care for older New Yorkers seeking long term care. The director must establish criteria for good standing for program participants, based on the ability of participants to assist in this demonstration program. Specifically, successful participants in the program should provide services to individuals who are identified by NY Connects program providers as needing respite care, home delivered meals, and in-home services provided by the aging network, as well as licensed home and community services and nursing home level of care. JUSTIFICATION: New York's long term care system has a wide range of inter-connected services and programs. A uniform assessment tool is being implemented by the Department of Health to ensure New Yorkers are receiving appropriate long term care services. The program created by this legislation seeks to demonstrate whether the uniform assessment tool is serving the needs of patients seeking all, including non-medical, levels of long term care. Many county operated New York Connects programs have participated in efforts to assess whether older New Yorkers at high risk of nursing home placement can be referred to home and community based services and avoid institutional placement. For individuals in need of long term care services, navigating New York State's long term care system can be challenging. Thus, involving county based NY Connects Program operators in evaluating the uniform assessment tool will help create standardization in determining appropriate levels of long term care, hopefully delaying nursing home placement and allowing older new yorkers to live independently for as long as possible. PRIOR LEGISLATIVE HISTORY: S.5077 of 2011-2012 FISCAL IMPLICATIONS: No additional cost to the state. Funding provided in this year's budget as part of the uniform assessment program shall be sub-allocated by the department of health to the office fox the aging to support the program's administration. EFFECTIVE DATE: 90 days after the bill becomes law.
