TITLE OF BILL:  An act to amend chapter 503 of the laws of 2012 relating
to authorizing the New York state urban development corporation to enter
into  agreements  to  develop a Cyber Research Institute, in relation to
cyber security activities

PURPOSE:   This bill authorizes  the  Mohawk  Valley  Regional  Economic
Development Council to coordinate cyber security activities at the Grif-
fiss Business and Technology Park.

SUMMARY  OF  PROVISIONS:   Makes technical changes to Chapter 503 of the
laws of 2012 which authorized, through public and private  partnerships,
the establishment of a Cyber Research Institute.

JUSTIFICATION:    The  Cyber  Research Institute to be established under
Chapter 503 of 2012 will address the important public need of conducting
research and development in the crucial  area  of  protecting  important
networked computer systems involved in military, governmental, and busi-
ness enterprises.

  AN  ACT to amend chapter 503 of the laws of 2012 relating to authorizing
    the New York state urban development corporation to enter into  agree-
    ments  to  develop  a  Cyber  Research Institute, in relation to cyber
    security activities

    THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
  BLY, DO ENACT AS FOLLOWS:


    Section  1.  The title of chapter 503 of the laws of 2012, relating to
  authorizing the New York state urban development  corporation  to  enter
  into  agreements  to  develop  a Cyber Research Institute, is amended to
  read as follows:

    AN ACT to authorize the [New York state urban development  corporation
  to  enter  into agreements to develop a Cyber Research Institute] MOHAWK
  VALLEY REGIONAL ECONOMIC DEVELOPMENT COUNCIL TO COORDINATE CYBER SECURI-
  TY ACTIVITIES AT GRIFFISS BUSINESS AND TECHNOLOGY PARK
    S 2. Sections 1 and 2 of chapter 503 of the laws of 2012  relating  to
  authorizing  the  New  York state urban development corporation to enter
  into agreements to development a Cyber Research Institute,  are  amended
  to read as follows:

    Section 1. Legislative Findings.  The legislature finds that the issue
  of  securing  networked  computer  systems  is of increasing importance.
  Governments at all levels, including the military,  private  businesses,
  and  individuals  have  increasingly become the targets of cyber attacks
  which range from theft  of  privileged  or  proprietary  information  to
  destructive  efforts  to  impede  or shut down systems which operate key
  elements of infrastructure, banking and business transactions, or  vital
  functions  of  government,  to  name  just a few. The increasing demands
  posed by this threat create a need for research and development  in  the
  area  of  cyber  security  in an environment which will allow pursuit of

  these studies in both an open academic setting and, also,  in  a  secure
  environment  for  classified  research.    The  United  States Air Force
  Research Lab at Rome, New York is presently conducting important work at
  its Information Assurance and Cyber Science Technology Laboratory. It is
  noted  that  several  private  businesses are presently engaged in cyber
  science work in close proximity to the Air Force Research Lab at Rome at
  the Griffiss Business and Technology Park, and several New York colleges
  and universities offer undergraduate  and  graduate  programs  in  cyber
  [science  and]  security AND COMPUTER RELATED SCIENCES. IN ADDITION, THE
  NEW YORK STATE DEPARTMENT OF ECONOMIC DEVELOPMENT, THROUGH ITS  DIVISION
  OF  SCIENCE  AND  TECHNOLOGY,  AND  THE  MOHAWK VALLEY REGIONAL ECONOMIC
  DEVELOPMENT COUNCIL ARE  CURRENTLY  COLLABORATING  WITH  THE  AIR  FORCE
  RESEARCH  LAB  AND  ITS  AFFILIATES  IN ROME TO ESTABLISH INITIATIVES TO
  PROMOTE INCREASED ECONOMIC GROWTH IN NEW YORK STATE THROUGH THE DEVELOP-
  MENT OF CYBER-BASED BUSINESSES AND  TECHNOLOGIES  AS  WELL  AS  TRAINING
  PROGRAMS  IN  THESE VITAL INDUSTRIES.  This combination of resources AND
  ACTIVITIES IN THE MOHAWK VALLEY uniquely positions the state of New York
  to become a leader in cyber security research and development BY HELPING
  IT ATTRACT, RETAIN AND GROW BUSINESSES FOCUSED ON  DEVELOPING  SOLUTIONS
  FOR CYBER SECURITY.
    S  2.  (a)  The  [New  York state urban development corporation  shall
  undertake to establish, through public and private  partnerships,  which
  shall  include the Air Force Research Laboratory at Rome, New York based
  colleges and universities, private businesses, and not-for-profit  enti-
  ties,] MOHAWK VALLEY REGIONAL ECONOMIC DEVELOPMENT COUNCIL SHALL COLLAB-
  ORATE  WITH  a Cyber Research Institute to be ESTABLISHED AND located at
  the Griffiss Business and Technology Park  in  Rome,  New  York.    Such
  institute  shall  be an independent not-for-profit corporation organized
  under the laws of the state of New York. [It  shall  be  governed  by  a
  board  of  directors  which  shall have at least eight and not more than
  twelve members, no fewer than three-quarters of whom shall be knowledge-
  able in fields directly  related  to  cyber  security  or  have  ongoing
  engagement  and  responsibility  in  the  cyber  security industry or in
  industries where cyber security is essential or shall have experience in
  teaching, research or applied work in the  area  of  cyber  security  in
  academic, business or government settings.]
    (b)  The [New York state urban development corporation shall work with
  the collaborating businesses and educational institutions,  as  well  as
  the Griffiss Local Development Corporation, to ensure that a cooperative
  working  relationship  is  established  between  those  institutions and
  potential participants of such research institute so that resources  are
  made  available and used in a responsible manner to support the success-
  ful development of the proposed research institute and the  creation  of
  ongoing  linkages  between  the  training, research, development, demon-
  stration and technology transfer resources of the region's higher educa-
  tion institutions, private sector businesses and the activities  located
  at  the  Griffiss Business and Technology Park] CYBER RESEARCH INSTITUTE
  SHALL COLLABORATE WITH THE AIR FORCE RESEARCH LABORATORY AT ROME,  BUSI-
  NESSES,  EDUCATIONAL  INSTITUTIONS,  NOT-FOR-PROFIT  ENTITIES,  FEDERAL,
  LOCAL AND OTHER NEW YORK STATE GOVERNMENTAL ENTITIES AND  OTHER  PARTIC-
  IPANTS IN THIS ARENA TO PROMOTE THE CREATION OF ONGOING LINKAGES BETWEEN
  THE TRAINING, RESEARCH, DEVELOPMENT, DEMONSTRATION AND TECHNOLOGY TRANS-
  FER  RESOURCES OF THE REGION'S HIGHER EDUCATION INSTITUTIONS AND PRIVATE
  SECTOR BUSINESSES; MAXIMIZE FEDERAL, STATE AND PRIVATE SECTOR  RESOURCES
  AND  DEPLOY  THOSE  RESOURCES  STRATEGICALLY  TO  ESTABLISH AND FOSTER A
  SUSTAINABLE PROGRAM THAT WILL GROW THE CYBER-BASED ECONOMY IN  NEW  YORK

  STATE  AND  PROTECT THE INTEGRITY OF CYBER-BASED INFRASTRUCTURE; PROMOTE
  AND INCREASE ECONOMIC ACTIVITY AS IT RELATES TO THE CYBER-BASED ECONOMY;
  FACILITATE THE TRANSFER OF CYBER TECHNOLOGY FROM THE  LAB  TO  PRACTICAL
  MARKET  APPLICATION;  EXPAND  THE  REGION'S  CYBER-BASED  WORKFORCE; AND
  PROMOTE NEW YORK  STATE  AS  THE  LEADER  IN  CYBER-BASED  RESEARCH  AND
  PROTECTION. THE CYBER RESEARCH INSTITUTE SHALL COORDINATE ITS ACTIVITIES
  WITH THE MOHAWK VALLEY REGIONAL ECONOMIC DEVELOPMENT COUNCIL.
    S 3. This act shall take effect on the same date as chapter 503 of the
  laws  of  2012 relating to authorizing the New York state urban develop-
  ment corporation to enter into agreements to develop  a  Cyber  Research
  Institute, took effect.
