TITLE OF BILL:

An act to amend the elder law, in relation to authorizing a pooled purchasing program for certain services and commodities

SUMMARY OF PROVISIONS:

Adds a new subdivision 11 to section 203 of the elder law, to authorize the state office for the aging to establish, operate, coordinate, encourage the development of, and/or maintain, or to contract for the operation of a pooled purchasing program for certain services and commodities, including but not limited to liability and vehicle insurance on behalf of entities, programs, and services for the aging over which it has jurisdiction, oversight, or other contractual relationship.

The ability to pool purchasing requests for automobile and liability insurance should result in lower costs for those entities under the jurisdiction of SOFA. Note that this does not require that SOFA establish a pool, only that it help in the creation of such pool or pools.

GOLDEN, AVELLA, GRIFFO, JOHNSON, LARKIN -- read twice and ordered printed, and when printed to be committed to the Committee on Aging -- recommitted to the Committee on Aging in accord- ance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the elder law, in relation to authorizing a pooled purchasing program for certain services and commodities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 203 of the elder law is amended by adding a new subdivision 11 to read as follows: 11. IN ADDITION TO THE POWERS AND DUTIES CONTAINED IN SECTION TWO HUNDRED TWO OF THIS TITLE, THE OFFICE IS HEREBY AUTHORIZED TO ESTABLISH, OPERATE, COORDINATE, ENCOURAGE THE DEVELOPMENT OF, AND/OR MAINTAIN, OR TO CONTRACT WITH OTHER NOT-FOR-PROFIT OR FOR-PROFIT OR PUBLIC ENTITIES ON BEHALF OF THOSE ENTITIES, PROGRAMS, AND SERVICES FOR THE AGING OVER WHICH IT HAS JURISDICTION, OVERSIGHT, OR OTHER CONTRACTUAL RELATIONSHIP, FOR THE OPERATION OF A POOLED PURCHASING PROGRAM FOR CERTAIN SERVICES AND COMMODITIES, INCLUDING, BUT NOT LIMITED TO, LIABILITY AND MOTOR VEHICLE INSURANCE, AS SHALL BE DETERMINED BY THE OFFICE AFTER CONSULTA- TION WITH THE ADVISORY COMMITTEE FOR THE AGING AND OTHERS. THE OFFICE SHALL ESTABLISH RULES AND REGULATIONS FOR THE OPERATION OF SUCH POOLED PURCHASING PROGRAMS IN WHICH IT IS INVOLVED. S 2. This act shall take effect immediately.
