BILL NUMBER:S230 TITLE OF BILL: An act to amend the correction law, in relation to requiring correctional facilities to distribute condoms to inmates PURPOSE: The purpose of this bill is to require correctional facilities to distribute condoms to inmates on a regular schedule without the request of an inmate. SUMMARY OF PROVISIONS: Section 1 adds §609 to the Correction Law requiring all correctional facilities to distribute condoms to inmates on a regular schedule free of charge and without request by the inmate. JUSTIFICATION: While in prison many inmates take part in dangerous sexual activities that lead to the spread of sexually transmitted diseases. This not only endangers the inmates but also those who come in contact with the inmates upon reentry in to society. Regular distribution of condoms to inmates would cut down on the spread of sexually transmitted diseases within our prisons thus creating a safer environment for those inside and outside the prison. Current laws make sexual activities within a prison illegal therefore an inmate will not ask for a condom in fear of punishment. For this reason the distribution of condoms on a regular schedule and without request is necessary for the safety and well being of our inmates and their loved ones. AN ACT to amend the correction law, in relation to requiring correction al facilities to distribute condoms to inmates
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. The correction law is amended by adding a new section 609 to read as follows:
S 609. DISTRIBUTION OF CONDOMS TO INMATES. THE WARDEN OR SUPERINTEN DENT OF EACH OF THE INSTITUTIONS WITHIN THE JURISDICTION OF THE DEPART MENT OF CORRECTIONAL SERVICES SHALL REGULARLY DISTRIBUTE CONDOMS FREE OF CHARGE TO EACH INMATE IN HIS OR HER CUSTODY. SUCH DISTRIBUTION SHALL BE PART OF A ROUTINE PROGRAM AND SHALL NOT REQUIRE A REQUEST BY AN INMATE.
