BILL NUMBER:S235 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to authorizing distinctive license plates for recipients of the conspicuous service cross PURPOSE: This bill authorizes the department of motor vehicles to issue distinctive license plates for recipients of the New York. State Conspicuous Service Cross. SUMMARY OF PROVISIONS: The vehicle and traffic law is amended by adding a new section 404-x authorizing the issuance of distinctive plates for Conspicuous Service Cross recipients. the plates are obtained by payment of a one-time fee. JUSTIFICATION: Conspicuous Service Cross recipients are combat veterans who served their country with valor. Many of them were wounded in battle. They deserve special recognition for their courage in the face of danger and their service to their country. AN ACT to amend the vehicle and traffic law, in relation to authorizing distinctive license plates for recipients of the conspicuous service cross
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. The vehicle and traffic law is amended by adding a new section 404-x to read as follows:
S 404-X. DISTINCTIVE PLATES FOR CONSPICUOUS SERVICE CROSS RECIPIENTS. 1. ANY CONSPICUOUS SERVICE CROSS RECIPIENT RESIDING IN THIS STATE OR THE SPOUSE OF ANY SUCH RECIPIENT SHALL, UPON REQUEST, BE ISSUED A LICENSE PLATE BEARING THE WORDS "CONSPICUOUS SERVICE CROSS RECIPIENT". IF A DISTINCTIVE PLATE IS ISSUED TO A CONSPICUOUS SERVICE CROSS RECIPIENT PURSUANT TO THIS SECTION, SUCH A DISTINCTIVE PLATE SHALL NOT BE ISSUED TO THE SPOUSE OF SUCH CONSPICUOUS SERVICE CROSS RECIPIENT. APPLICATION FOR SAID LICENSE PLATE SHALL BE FILED WITH THE COMMISSIONER IN SUCH FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE. 2. THE DISTINCTIVE PLATE AUTHORIZED BY THIS SECTION SHALL BE ISSUED UPON PROOF, SATISFACTORY TO THE COMMISSIONER, THAT THE APPLICANT OR THE SPOUSE OF THE APPLICANT IS A CONSPICUOUS SERVICE CROSS RECIPIENT. 3. A DISTINCTIVE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED IN THE SAME MANNER AS OTHER NUMBER PLATES UPON PAYMENT OF THE REGULAR REGISTRATION FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE; PROVIDED, HOWEVER, THAT AN ADDITIONAL, ONE-TIME SERVICE CHARGE OF TEN DOLLARS SHALL BE CHARGED FOR SUCH PLATE. SUCH ANNUAL SERVICE CHARGE SHALL BE DEPOSITED PURSUANT TO THE PROVISIONS OF SECTION FOUR HUNDRED FOUR-OO OF THIS ARTICLE TO THE CREDIT OF THE DEPARTMENT OF MOTOR VEHI CLES DISTINCTIVE PLATE DEVELOPMENT FUND ESTABLISHED BY SECTION NINETY-FIVE-G OF THE STATE FINANCE LAW AND SHALL BE USED FOR THE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law.
