BILL NUMBER:S2364 TITLE OF BILL: An act to amend the environmental conservation law, in relation to private trout and black bass hatcheries PURPOSE: The purpose of this bill is to authorize the sale of hatchery-raised trout and black bass for commercial purposes for consumption or resale. EXISTING LAW: New York State law does not currently authorize the sale of hatchery-raised trout or black bass for commercial purposes for consumption or resale. JUSTIFICATION: New York State law does not currently authorize the sale of hatchery-raised trout or black bass for commercial purposes for consumption or resale. Because of this, unlike many other states, hatchery-raised trout or black bass are not permitted to be sold to restaurants in New York State. Current law unnecessarily prohibits this business opportunity along with the jobs, tax revenue and other potential benefits which would come with it. This bill would remove this prohibition by providing that hatchery permits issued by the Department of Environmental Conservation would authorize the sale of hatchery-raised trout or black bass for commercial purposes for consumption or resale. LEGISLATIVE HISTORY: S.3059 of 2009-10; S.7549 of 2008 FISCAL IMPLICATIONS: None. EFFECTIVE DATE: Immediately.
