BILL NUMBER:S2388A TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to the registration of vintage snowmobiles PURPOSE: To require vintage snowmobiles that are used for participation in club activities, exhibits, tours, parades, occasional transportation and similar uses, but not used for general snowmobiling purposes, to pay a reduced portion of the snowmobile registration fee that is deposited into the Snowmobile Trail Development and Maintenance Fund. SUMMARY OF PROVISIONS: Section 1: Required vintage snowmobiles that are used only for participation in club activities, exhibits, tours, parades, occasional transportation and similar uses, but not used for general snowmobiling purposes, to pay ten dollars annually if the registrant is a member of an organized club, and twenty dollars annually if the registrant is not a member of an organized club. The fees are a reduced portion of the snowmobile registration fee that is deposited into the Snowmobile Trail Development and Maintenance Fund. Section 2: Requires that the registration stickers for vintage snowmobiles be of a different color than other registration stickers for snowmobiles. The registration sticker is not required to be affixed to the snowmobile, but must be readily available to the operator and presented on demand by a law enforcement officer. Section 3: Defines a vintage snowmobile as any snowmobile manufactured more than thirty years prior to the current calendar year, or any other model, year and type snowmobile which has unique characteristics and is determined by the commissioner to be of historical; classic, or exhibition value. Section 4: A person who owns or operates a snowmobile which is registered as a vintage snowmobile and such snowmobile is not a vintage snowmobile as defined shall be subject to a fine of$200. EXISTING LAW: The current snowmobile registration fee is $45 for New York State Snowmobile Association (NYSSA) members and $100 for non-members. JUSTIFICATION: Requiring individuals who use their vintage snowmobiles for participation in club activities, exhibits, tours, parades, occasional transportation and similar uses, but do not use them for general snowmobile purposes to pay into the Snowmobile Trail Development and Maintenance Fund is unfair, as these individuals do not use the trail system. LEGISLATIVE HISTORY: S.3042 of 2009-10. FISCAL IMPLICATIONS: Unknown at this time. EFFECTIVE DATE: 90 days after becoming a law.

AN ACT to amend the vehicle and traffic law, in relation to the regis-
tration of vintage snowmobiles
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 2222 of the vehicle and traffic law is amended by
adding a new subdivision 4-b to read as follows:
4-B. (A) FEES FOR VINTAGE SNOWMOBILES. NOTWITHSTANDING ANY OTHER LAW,
RULE OR REGULATION TO THE CONTRARY, FEES FOR REGISTRATION OF A VINTAGE
SNOWMOBILE WHICH IS OWNED AND OPERATED AS AN EXHIBITION PIECE OR COLLEC-
TOR'S ITEM, AND IS USED FOR PARTICIPATION IN CLUB ACTIVITIES, EXHIBITS,
TOURS, PARADES, OCCASIONAL TRANSPORTATION AND SIMILAR USES, BUT NOT USED
FOR GENERAL SNOWMOBILING PURPOSES, SHALL BE AS FOLLOWS (I) TEN DOLLARS
ANNUALLY IF THE REGISTRANT IS A MEMBER OF AN ORGANIZED CLUB AS SET FORTH
IN SUBDIVISION FOUR-A OF THIS SECTION, AND (II) TWENTY DOLLARS ANNUALLY
IF THE REGISTRANT IS NOT A MEMBER OF SUCH A CLUB; PROVIDED THAT THE
REGISTRANT OF A VINTAGE SNOWMOBILE SHALL NOT BE SUBJECT TO THE ADDI-
TIONAL FEES SET OUT IN SUBDIVISION FOUR-A OF THIS SECTION, AND SECTION
21.07 OF THE PARKS, RECREATION AND HISTORIC PRESERVATION LAW.
(B) THE REGISTRATION STICKER FOR VINTAGE SNOWMOBILES WHICH SHALL BE
USED ONLY FOR VINTAGE SNOWMOBILES SHALL BE OF A DIFFERENT COLOR THAN
OTHER REGISTRATION STICKERS FOR SNOWMOBILES. SUCH REGISTRATION STICKER
SHALL NOT BE REQUIRED TO BE AFFIXED TO THE SNOWMOBILE, BUT SHALL BE
REQUIRED TO BE READILY AVAILABLE TO THE OPERATOR AND PRESENTED ON DEMAND
BY A LAW ENFORCEMENT OFFICER.
(C) FOR PURPOSES OF THIS SUBDIVISION, A VINTAGE SNOWMOBILE SHALL MEAN
ANY SNOWMOBILE MANUFACTURED THIRTY OR MORE YEARS PRIOR TO THE CURRENT
EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
[ ] is old law to be omitted.

CALENDAR YEAR, AND ANY OTHER MODEL, YEAR AND TYPE SNOWMOBILE WHICH HAS
UNIQUE CHARACTERISTICS AND WHICH IS DETERMINED BY THE COMMISSIONER TO BE
OF HISTORICAL, CLASSIC OR EXHIBITION VALUE.
(D) A PERSON WHO OWNS OR OPERATES A SNOWMOBILE WHICH IS REGISTERED AS
A VINTAGE SNOWMOBILE AND SUCH SNOWMOBILE IS NOT A VINTAGE SNOWMOBILE AS
DEFINED IN PARAGRAPH (C) OF THIS SUBDIVISION SHALL BE GUILTY OF A
VIOLATION AND SHALL BE SUBJECT TO A FINE OF TWO HUNDRED DOLLARS.
S 2. This act shall take effect on the ninetieth day after it shall
have become a law, provided that the commissioner of motor vehicles is
immediately authorized and directed to promulgate and/or repeal any
rules and regulations necessary to implement the provisions of this act
on its effective date.
