BILL NUMBER:S2397 TITLE OF BILL: An act to amend the judiciary law, in relation to exempting residents seventy-five years of age or older from serving on juries PURPOSE: To permit prospective jurors having attained the age of seventy-five to be exempt from jury duty. SUMMARY OF PROVISIONS: Section 1 amends Section 509 of the judiciary law by adding a new subdivision (c) providing that on the juror qualification questionnaire the commissioner shall provide the option for those prospective jurors having attained the age of seventy-five to decline participation in the instant case and/or all future cases Section 2 provides the effective date. JUSTIFICATION: In 1996, at the behest of then Chief Judge Judith Kaye, the Legislature eliminated all of the automatic jury service exemptions.

RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the judiciary law, in relation to exempting residents seventy-five years of age or older from serving on juries THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 509 of the judiciary law is amended by adding a new subdivision (c) to read as follows: (C) ON THE JUROR QUALIFICATION QUESTIONNAIRE, THE COMMISSIONER SHALL PROVIDE THE OPTION FOR THOSE PROSPECTIVE JURORS HAVING ATTAINED THE AGE OF SEVENTY-FIVE TO DECLINE PARTICIPATION IN THE INSTANT CASE AND/OR ALL FUTURE CASES AT THE SOLE DISCRETION OF THE PERSON TO WHOM THE QUESTION- NAIRE IS MAILED. S 2. This act shall take effect immediately and shall apply to legal cases initiated on or after such effective date.
