TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to creating distinctive plates for the New York city fire riders motorcycle club

PURPOSE: To allow for distinctive plates to be issued for members of the New York City Fire Riders Motor Cycle Club.

SUMMARY OF PROVISIONS: This bill amends the vehicle and traffic law by adding a new section 404-x to allow the Commissioner of the Department of Motor Vehicles to issue distinctive plates to the New York City Fire Riders Motor Cycle Club. A person requesting such plates must be a resident of New York State and an active or retired member of the club. The plates shall be issued upon payment of the regular registration fee and an additional annual service charge of $15 shall be charged for each plate.

JUSTIFICATION: The New York City Fire Riders Motor Cycle Club is a fraternal Fire Department of New York City organization with over 300 members. The New York City Fire Riders Motorcycle Club was established in January of 1985. The club was created to unite firefighters and promote safe motorcycling. The original group consisted of 16 members and there is now a chapter in Nassau County. The New York City Fire Riders Motorcycle Club is also affiliated with the Red Knights International Motorcycle Club and the Wind & Fire Motorcycle Club. These affiliations present the club with many opportunities to travel into Canada to fellowship within the brotherhood of firefighters. This legislation would allow for the issuance of a distinctive license plate for active and retired firefighters belonging to the New York City Fire Riders Motor Cycle Club. These club members would like to display their pride as present and former New York City Firefighters who are also proud motorcycle owners. This bill shows New York State's appreciation toward these particular individuals who bravely serve or have bravely served the residents of the City of New York.

LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to creating distinctive plates for the New York city fire riders motorcycle club THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 404-x to read as follows: S 404-X. DISTINCTIVE PLATES FOR NEW YORK CITY FIRE RIDERS MOTORCYCLE CLUB. 1. ANY MEMBER OF THE NEW YORK CITY FIRE RIDERS MOTORCYCLE CLUB SHALL, UPON REQUEST, BE ISSUED A LICENSE PLATE BEARING THE WORDS "NYC FIRE RIDERS". APPLICATION FOR SAID LICENSE PLATE SHALL BE FILED WITH THE COMMISSIONER IN SUCH FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE. 2. A DISTINCTIVE PLATE AUTHORIZED BY SUBDIVISION ONE OF THIS SECTION SHALL BE ISSUED UPON PROOF, SATISFACTORY TO THE COMMISSIONER, THAT THE APPLICANT IS A MEMBER OF THE NEW YORK CITY FIRE RIDERS MOTORCYCLE CLUB. 3. FOR THE PURPOSES OF THIS SECTION, "MEMBER OF THE NEW YORK CITY FIRE RIDERS MOTORCYCLE CLUB" SHALL MEAN A PERSON WHO IS A RESIDENT OF THIS STATE, WHO IS AN ACTIVE OR RETIRED UNIFORMED MEMBER OF THE NEW YORK CITY FIRE DEPARTMENT AND WHO HOLDS AN ACTIVE MEMBERSHIP IN THE NEW YORK CITY FIRE RIDERS MOTORCYCLE CLUB. 4. A DISTINCTIVE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED IN THE SAME MANNER AS OTHER NUMBER PLATES UPON THE PAYMENT OF THE REGU- LAR REGISTRATION FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE, PROVIDED, HOWEVER, THAT AN ADDITIONAL ANNUAL SERVICE CHARGE OF FIFTEEN DOLLARS SHALL BE CHARGED FOR SUCH PLATE. 5. NOTHING IN THIS SECTION SHALL REQUIRE THE ISSUANCE OF A DISTINCTIVE NUMBER PLATE UNDER THIS SECTION UNLESS THE COMMISSIONER IS SATISFIED THAT THE AGGREGATE AMOUNT OF ANNUAL SERVICE CHARGES COLLECTED PURSUANT TO SUBDIVISION FOUR OF THIS SECTION WILL BE SUFFICIENT TO RECOVER THE
COSTS OF THE DESIGN AND MANUFACTURE OF SUCH DISTINCTIVE PLATES. SUCH ANNUAL SERVICE CHARGE SHALL BE DEPOSITED PURSUANT TO THE PROVISIONS OF SECTION FOUR HUNDRED FOUR-OO OF THIS CHAPTER TO THE CREDIT OF THE DEPARTMENT OF MOTOR VEHICLES DISTINCTIVE PLATE DEVELOPMENT FUND ESTAB- LISHED BY SECTION NINETY-FIVE-G OF THE STATE FINANCE LAW AND SHALL BE USED FOR THE PRODUCTION, DESIGN, ADVERTISING AND MARKETING OF DISTINC- TIVE LICENSE PLATES PURSUANT TO SUCH SECTION NINETY-FIVE-G. S 2. This act shall take effect immediately.
