TITLE OF BILL: An act to amend the administrative code of the city of New York, in relation to requiring that in all new commercial development streets and abutting streets must be widened to the maximum allowable width

PURPOSE: Provides that new streets within abutting streets of new commercial projects in New York City be the maximum legal width.

SUMMARY OF SPECIFIC PROVISIONS:

Section one amends the administrative code of the city of New York by adding a new section 28-108.4.

JUSTIFICATION: Currently when new commercial projects are constructed in the City of New York developers of commercial and residential properties have the right to go to the Department of Transportation when filing a Builders Paving Plan (BPP) for a waiver if there is a widening ran a property.

This bill requires developers of commercial construction projects to make sure that all streets abutting such projects are the maximum legal width. This legislation ensures that the Department of Transportation does not issue waivers for new commercial construction where a street must be widened.

This proposal will assist in reducing traffic in already narrow streets where commercial developments are Proposed.

LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Cities AN ACT to amend the administrative code of the city of New York, in relation to requiring that in all new commercial development streets and abutting streets must be widened to the maximum allowable width THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The administrative code of the city of New York is amended by adding a new section 28-108.4 to read as follows: S 28-108.4 STREET WIDTH FOR NEW COMMERCIAL CONSTRUCTION. DEVELOPERS OF NEW COMMERCIAL CONSTRUCTION PROJECTS SHALL BE REQUIRED TO CONSTRUCT ALL NEW STREETS WITHIN THE PROJECT AND WIDEN ALL EXISTING STREETS ABUT- TING THE PROJECT TO THE MAXIMUM LEGAL WIDTH FOR SUCH STREETS. NO WAIVER OF SUCH REQUIREMENT SHALL BE GRANTED. S 2. This act shall take effect immediately.
