BILL NUMBER: S247 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to the operation of a motor vehicle without a license; and to repeal subdivision 1 of section 509 of such law relating to the operation of a motor vehicle without a license PURPOSE : The purpose of this bill is to strengthen the penalties for unlicensed operation of a motor vehicle SUMMARY OF PROVISIONS : Section one amends paragraph a of subdivision 1 of section 511 of the vehicle and traffic law, as amended by chapter 173 of the laws of 1990, by establishing that an individual who operates a motor vehicle without being duly licensed is guilty of aggravated unlicensed operation of a motor vehicle in the third degree. Section two repeals subdivision one of section 509 of the vehicle and traffic law. Section three sets the effective date. JUSTIFICATION :

MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the opera- tion of a motor vehicle without a license; and to repeal subdivision 1 of section 509 of such law relating to the operation of a motor vehi- cle without a license THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 1 of section 511 of the vehi- cle and traffic law, as amended by chapter 173 of the laws of 1990, is amended to read as follows: (a) A person is guilty of the offense of aggravated unlicensed opera- tion of a motor vehicle in the third degree when such person operates a motor vehicle upon a public highway OF THIS STATE OR UPON ANY SIDEWALK OR TO OR FROM ANY LOT ADJACENT TO A PUBLIC GARAGE, SUPERMARKET, SHOPPING CENTER OR CAR WASHING ESTABLISHMENT OR TO OR FROM OR INTO A PUBLIC GARAGE OR CAR WASHING ESTABLISHMENT (I) WITHOUT BEING DULY LICENSED PURSUANT TO THE PROVISIONS OF THIS CHAPTER, EXCEPT WHILE OPERATING A MOTOR VEHICLE DURING THE COURSE OF A ROAD TEST CONDUCTED PURSUANT TO THE PROVISIONS OF THIS ARTICLE, OR (II) while knowing or having reason to know that such person's license or privilege of operating such motor vehicle in this state or privilege of obtaining a license to operate such motor vehicle issued by the commissioner is suspended, revoked or otherwise withdrawn by the commissioner. S 2. Subdivision 1 of section 509 of the vehicle and traffic law is REPEALED. S 3. This act shall take effect on the sixtieth day after it shall have become a law.
