BILL NUMBER:S2515 TITLE OF BILL: An act to amend the executive law, in relation to authorizing the division of veterans' affairs to provide for the interment of the unclaimed remains of veterans PURPOSE OR GENERAL IDEA: Authorizes the division of veterans' affairs to provide for the interment of the unclaimed remains of veterans. SUMMARY OF SPECIFIC PROVISIONS: Section 353 of the executive law is amended by adding a new subdivision 12-a, that would provide, in cooperation of veterans service organizations, for the interment of the unclaimed remains of veterans and direct the state director to consult with veterans service organizations to analyze the scope of the issue of unclaimed remains for veterans. JUSTIFICATION: Too often, when a veteran dies and is subsequently cremated, their remains, whether due to neglect by loved ones or lack thereof, go unclaimed and are left to sit on the shelf of mortuaries. This practice is most inappropriate considering their heroic service to our country. This legislation would ensure that the unclaimed remains of our service men and women will be rightfully interred with the dignity they deserve. PRIOR LEGISLATIVE HISTORY: None. FISCAL IMPLICATIONS: To be determined. EFFECTIVE DATE: This act shall take effect on the first of January next succeeding the date on which it shall have become law.

AN ACT to amend the executive law, in relation to authorizing the divi sion of veterans' affairs to provide for the interment of the unclaimed remains of veterans THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1.
Section 353 of the executive law is amended by adding a new subdivision 12-a to read as follows:
12-A. TO PROVIDE, IN COOPERATION WITH VETERANS SERVICE ORGANIZATIONS, FOR THE INTERMENT OF THE UNCLAIMED REMAINS OF VETERANS. THE STATE DIRECTOR SHALL CONSULT WITH VETERANS SERVICE ORGANIZATIONS TO ANALYZE THE SCOPE OF THE ISSUE OF UNCLAIMED REMAINS OF VETERANS. FOR THE PURPOSES OF THIS SUBDIVISION, "UNCLAIMED REMAINS OF A VETERAN" SHALL MEAN THE REMAINS OF A VETERAN THAT ARE CONSIDERED UNCLAIMED UNDER THE LAWS OF THIS STATE AND/OR ANY OTHER STATE OF THE UNITED STATES.
