BILL NUMBER:S2676 TITLE OF BILL: An act to amend the public lands law, in relation to the payment of state aid on account of certain state lands in the town of Ashford, in the county of Cattaraugus PURPOSE: The purpose of this bill is to provide for the payment of State aid to the Town of Ashford, in the County of Cattaraugus, and the special districts therein fox state lands in such town. SUMMARY OF PROVISIONS: Section 1 of this bill adds a new section 19-c to the Public Lands Law to provide for the payment of $500,000 in State aid annually to the Town of Ashford in the County of Cattaraugus, for lands owned by the state or a state agency in such town. Section 2 requires that this act shall take effect immediately, and the first payment of state aid shall be in the year 2014. EXISTING LAW: Section 19-b of the Public Lands Law currently provides for the payment of State aid for the West Valley Nuclear sight based on tax rolls from 1980. In addition, Sections 532, 534, and 536 of the Real Property and Tax Law make certain State lands (not including the Town of Ashford) taxable for some or all local government purposes. JUSTIFICATION: The lands that would be the subject of State aid payments were used by the state for the West Valley Demonstration project. Despite accounting for 86% of the taxable land in the Town of Ashford, the state aid payments, which are based on a 1980 assessment, have not increased since 1996. Because a significant amount of the acreage in the Town is tax-exempt State property, the Town finds itself in a fiscally challenged position with a constrained and overburdened tax base. This bill would help alleviate this situation by providing an additional $500,000 in yearly State aid payments to the Town of Ashford, to offset the loss of tax revenue. EFFECTIVE DATE: This act shall take effect immediately and the first payment of State aid shall be based upon assessment rolls completed in 2014.

AN ACT to amend the public lands law, in relation to the payment of state aid on account of certain state lands in the town of Ashford, in the county of Cattaraugus
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. The public lands law is amended by adding a new section 19-c to read as follows:
S 19-C. STATE AID; CERTAIN STATE LANDS IN THE TOWN OF ASHFORD. 1. STATE AID SHALL BE PAYABLE ANNUALLY, AS PROVIDED IN THIS SECTION, TO THE TOWN OF ASHFORD, IN THE COUNTY OF CATTARAUGUS, AND TO ANY SPECIAL DISTRICT, AS DEFINED IN SUBDIVISION SIXTEEN OF SECTION ONE HUNDRED TWO OF THE REAL PROPERTY TAX LAW, WITHIN SUCH TOWN, FOR ANY PARCEL OF LAND OWNED BY THE STATE, OR AN AGENCY OF THE STATE. 2. THE STATE AID SO PAYABLE SHALL BE EQUAL TO FIVE HUNDRED THOUSAND DOLLARS. 3. STATE AID SHALL BE PAYABLE UPON APPLICATION OF THE TOWN BOARD OF THE TOWN OF ASHFORD ON BEHALF OF SUCH TOWN AND THE SPECIAL DISTRICTS THEREIN TO THE STATE COMPTROLLER ON A FORM PRESCRIBED BY THE STATE COMP TROLLER CONTAINING SUCH INFORMATION AS THE STATE COMPTROLLER SHALL REQUIRE.
S 2. This act shall take effect immediately and the first payment of state aid pursuant to section 19-c of the public lands law, as added by section one of this act, shall be in 2014.
