TITLE OF BILL: An act to amend the public officers law, in relation to peace officers employed by Cornell University; and to repeal subdivision 59 of section 3 of such law relating thereto

PURPOSE OR GENERAL IDEA OF BILL: To allow for Cornell University, Ithaca campus to hire campus police officers who live outside of Tompkins County.

SUMMARY OF SPECIFIC PROVISIONS:

Section one of the bill repeals amendments made by a chapter of the laws of 2012 amending the public officers law, as proposed in S.7485-A. Section two of the bill adds a new subdivision in section 3-b of the public officers law.

JUSTIFICATION: In order to improve hiring, and allow for greater freedom of residency location, the legislation would allow for Cornell University police officers, who are assigned to the Ithaca campus, to reside outside of Tompkins County, and still perform their official functions at the university.

PRIOR LEGISLATIVE HISTORY: New Bill.

FISCAL IMPLICATIONS: Undetermined.

EFFECTIVE DATE: Immediately; provided that section one of this act shall take effect on the same date as a chapter of the laws of 2012 amending the public officers law relating to residency requirements for peace officers employed by Cornell University, as proposed in legislative bills numbers S.7485-A and A.10400-A, takes effect.

Introduced by Sen. O'MARA -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public officers law, in relation to peace officers employed by Cornell University; and to repeal subdivision 59 of section 3 of such law relating thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 59 of section 3 of the public officers law, as added by chapter 499 of the laws of 2012, is REPEALED. S 2. Section 3-b of the public officers law is amended by adding a new subdivision 5 to read as follows: 5. IN RESPECT TO PEACE OFFICERS EMPLOYED BY CORNELL UNIVERSITY, AND ASSIGNED TO THE ITHACA CAMPUS, PURSUANT TO SECTION FIFTY-SEVEN HUNDRED NINE OF THE EDUCATION LAW, THE PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE SAME COUNTY AS THE APPOINTING OFFICIAL SHALL NOT PREVENT A PERSON FROM SERVING AS A PEACE OFFICER FOR CORNELL UNIVERSITY, OR AS A SPECIAL DEPUTY SHERIFF, AND ASSIGNED TO THE ITHACA CAMPUS, AS DEFINED IN SUBDIVISION FORTY-TWO OF SECTION 2.10 OF THE CRIM- INAL PROCEDURE LAW, PROVIDED THAT SUCH PERSON RESIDES IN THE STATE OF NEW YORK. S 3. This act shall take effect immediately.
