TITLE OF BILL:  An act to amend chapter 430 of the laws of 2012 relating
to a certain agreement for a payment in lieu of taxes, in relation to
the effectiveness thereof

SUMMARY OF SPECIFIC PROVISIONS: The bill clarifies that the provisions
of L. 2012, c. 430 are only applicable for taxable years 2008 through
2012.

JUSTIFICATION: This legislation is needed to ensure that a leased prop-
erty in the City of Poughkeepsie that was granted a qualifying empire
zone enterprise is not unduly burdened with unexpected tax obligations
as a result of "reach back" due to a change in policy by the New York
State Department of Taxation and Finance.

  AN ACT to amend chapter 430 of the laws of 2012 relating  to  a  certain
    agreement  for  a  payment in lieu of taxes, in relation to the effec-
    tiveness thereof

    THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
  BLY, DO ENACT AS FOLLOWS:


    Section  1. Section 2 of chapter 430 of the laws of 2012 relating to a
  certain agreement for a payment in lieu of taxes, is amended to read  as
  follows:

    S  2.  This  act shall take effect immediately and shall ONLY apply to
  taxable years beginning on and after January 1, 2008 AND  ENDING  ON  OR
  BEFORE DECEMBER 31, 2012.
    S 2. This act shall take effect immediately.
