TITLE OF BILL: An act to legalize, validate, ratify and confirm the abolition of the Sanford Fire District by the town of Sanford, in the county of Broome and providing for the repeal of such provisions upon expiration thereof
PURPOSE: The purpose of this bill is to dissolve the Sanford fire district and establish the Sanford fire protection district.
SUMMARY OF PROVISIONS: Section 1. Notwithstanding any provision of the town law or insurance law, all proceedings and actions taken by the town of Sanford in the county of Broome, in relation to the abolition of the offices of fire district commissioners of the Sanford Fire District and transfer of their functions to the town board and town supervisor, including executing contracts for fire protection, redistributing foreign fire insurance premium tax funds and the establishment of any account of funds from real property taxes of the fire district, are hereby legalized, validated, ratified and confirmed.
Section 2. Notwithstanding the defects described in section one, to town board of the town of Sanford is hereby authorized to initiate proceedings pursuant to article 17-A of the general municipal law to dissolve the Sanford Fire District as if the town board were the governing body of the Sanford Fire District.
Section 3 makes this act take effect immediately and be deemed repealed on July 1, 2012.
JUSTIFICATION: Currently, the town of Sanford is faced with a problem concerning its fire district. Per the Comptroller's recommendation, the town of Sanford requested legislation be drafted by their state officials to abolish the town of Sanford fire district and form the town of Sanford fire protection district.
