TITLE OF BILL: An act to amend the environmental conservation law, in relation to allowing the use of rifles for hunting in certain portions of Ontario county

PURPOSE OR GENERAL IDEA OF BILL: This bill would allow the hunting of deer and bear through the use of a rifle in Ontario County by restricting same to the area within the county south of U.S. Route 20/New York State Route 5.

JUSTIFICATION: At the request of Ontario County, certain portions of that county south of U.S. Route 20/New York State Route 5 would be included in those areas where sportsmen and women are able to hunt deer and bear with rifles. Since 2005, several counties in Southern-and Central New York have been allowed to permit hunting of deer and bear with rifles. There have been very few reported adverse incidents or problems. Given the rural nature of that portion of Ontario County south of U.S. Route 20/New York State Route 5 and the safety record of hunters in the counties where rifle hunting has been permitted, it would be reasonable to now permit rifle hunters in southern Ontario County the same opportunities. This bill corrects the description of the portion of the county to which it applies, satisfying the concern raised in the Governor's veto message.

PRIOR LEGISLATIVE HISTORY: 2009 S.6057/A.7581 passed both houses, but was vetoed by the Governor. S.7006 of 2010

FISCAL IMPLICATIONS: None.

EFFECTIVE DATE: This act shall take effect immediately; with provisions.

Item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as separately amended by chapters 321 and 326 of the laws of 2011, is amended to read as follows: (i) The counties of Deer, the first Monday Pistol, shotgun, Allegany, Cattaraugus, after November 15 crossbow, Chautauqua except through first Tuesday muzzle loading that portion of after December 7 firearm, rifle or the county north of long bow only route 20, Chemung, Chenango, Herkimer, Madison, Montgomery, Oneida, Oswego, Otsego, Schoharie, Schuyler, Steuben, Tioga, Wyoming and Yates [and], that portion of the county of Broome east of the
Susquehanna river, AND THAT PORTION OF THE COUNTY OF ONTARIO SOUTH OF U.S. ROUTE 20/NEW YORK STATE ROUTE 5 S 2. Item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as amended by section 11 of chapter 483 of the laws of 2010, is amended to read as follows: (i) The counties of Deer, the first Monday Pistol, shotgun, Allegany, after November 15 crossbow, Cattaraugus, Chemung, through first Tuesday muzzle loading Chenango, Herkimer, after December 7 firearm, rifle or Madison, long bow only Montgomery, Oneida, Oswego, Otsego, Schoharie, Schuyler, Steuben, Tioga [and], Yates and that portion of the county of Broome east of the Susquehanna river, AND THAT PORTION OF THE COUNTY OF ONTARIO SOUTH OF U.S. ROUTE 20/NEW YORK STATE ROUTE 5 S 3. Item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as separately amended by section 1 of chapters 173, 202 and 203 of the laws of 2011, is amended to read as follows: (i) The counties of Deer and bear, the Pistol, shotgun, Allegany, Cattaraugus, first Monday after crossbow, Chemung, Chenango, November 15 through muzzle loading Herkimer, Madison, first Tuesday after firearm, rifle or Montgomery, Oneida, December 7 long bow only Oswego, Otsego, Schoharie, Schuyler, Steuben, Tioga, [and], Yates and that portion of the county of Broome east of the Susquehanna river, AND THAT PORTION OF THE COUNTY OF ONTARIO SOUTH OF U.S. ROUTE 20/NEW YORK STATE ROUTE 5 S 4. Item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as separately amended by section 2
of chapters 173, 202 and 203 of the laws of 2011, is amended to read as follows: (i) The counties of Deer and bear, the Pistol, shotgun, Allegany, Cattaraugus, first Monday after muzzle loading Chemung, Chenango, November 15 through firearm, rifle or Herkimer, Madison, first Tuesday after long bow only Montgomery, Oneida, December 7 Oswego, Otsego, Schoharie, Schuyler, Steuben, Tioga, [and], Yates, and that portion of the county of Broome east of the Susquehanna river, AND THAT PORTION OF THE COUNTY OF ONTARIO SOUTH OF U.S. ROUTE 20/NEW YORK STATE ROUTE 5 S 5. This act shall take effect immediately, provided that the amend- ments to item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section one of this act shall be subject to the expiration and reversion of such item pursuant to section 3 of chapters 321 and 326 of the laws of 2011, when upon such date the provisions of section two of this act shall take effect; the amendments to item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section two of this act shall be subject to the expiration and reversion of such item pursuant to section 13 of chapter 600 of the laws of 1993, as amended, when upon such date the provisions of section three of this act shall take effect; provided further, that the amendments to item (i) of para- graph a of subdivision 2 of section 11-0907 of the environmental conser- vation law made by section three of this act shall be subject to the expiration and reversion of such item pursuant to section 17 of chapter 483 of the laws of 2010, as amended, when upon such date the provisions of section four of this act shall take effect.
