Establishes a biodiesel grant program for the agricultural production of biodiesel fuel; defines biodiesel fuel as a renewable, biodegradable, mono alkyl ester combustible liquid fuel derived from jatropha plants, algae production, mustard seed, animal fats and/or waste greases and oils; establishes the biodiesel grant program fund.
TITLE OF BILL: An act to amend the public authorities law and the state finance law, in relation to a grant program for the agricultural production of biodiesel fuel and a fund for the administration of such program
PURPOSE OR GENERAL IDEA OF BILL: To provide grants of matching funds for the costs associated with the agricultural production of biodiesel fuel.
SUMMARY OF PROVISIONS: Establishes that all moneys received or accepted pursuant to this section shall be deposited into the Biodiesel grant fund. Biodiesel fuel is defined as renewable, biodegradable, mono alkyl ester combustible liquid fuel derived from jatropha plants, algae production, mustard seed, animal fats, other agricultural plant oils and/or waste greases and oils.
JUSTIFICATION: Biodiesel is a fuel that can decrease our dependency on foreign oils, decrease global warming and provide an alternative to tradition petro fuels.
It is our hope to establish a way for farmers to maximize profits while exploring alternatives for fuel production in New York state.

THE AUTHORITY SHALL ESTABLISH GUIDELINES FOR THE APPLICATION AND ADMINISTRATION OF THE BIODIESEL GRANT PROGRAM. S 2. The state finance law is amended by adding a new section 99-t to read as follows: S 99-T. BIODIESEL GRANT PROGRAM FUND. 1. THERE IS HEREBY ESTABLISHED IN THE JOINT CUSTODY OF THE COMPTROLLER AND THE CHAIRMAN OF THE NEW YORK STATE ENERGY RESEARCH AND DEVELOPMENT AUTHORITY, A FUND TO BE KNOWN AS THE BIODIESEL GRANT PROGRAM FUND. 2. GRANT PROGRAM ESTABLISHED BY SECTION EIGHTEEN HUNDRED EIGHTY-FOUR OF THE PUBLIC AUTHORITIES LAW. S 3. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law. Effective immediately, the New York state energy research and development authority shall establish any rules or regulations necessary for the implementation of this act on its effective date.
