BILL NUMBER:S3018

TITLE OF BILL:  An act to amend the education law, in relation to
supplemental educational improvement plan grants

PURPOSE:  This bill captures regional cost indexes in calculating SEIP
grants.

SUMMARY OF SPECIFIC PROVISIONS:

Section I of this bill amends Paragraph B of Subdivision 8 of Section
3641 of the Education Law, as amended by Section 29 of Part B of
Chapter 57 of the laws of 2008 to read as follows: To the Yonkers City
School District there shall be paid seventeen million five hundred
thousand dollars multiplied by such District's regional cost index.

JUSTIFICATION:  Regional cost indexes were recently adopted under the
State's new Foundation Aid formula for public education. Certain
school districts, however, may also receive SEIP grants, which are
designed to provide additional State funds for the continuation of
programs and services under a court ordered plan. These funds should
also be subject to the regional cost differences accounted for in the
new school aid formula.

  AN ACT to amend the education law, in relation  to  supplemental  educa-
    tional improvement plan grants

    THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
  BLY, DO ENACT AS FOLLOWS:


    Section 1. Paragraph b of subdivision 8 of section 3641 of the  educa-
  tion  law,  as amended by section 29 of part B of chapter 57 of the laws
  of 2008, is amended to read as follows:

    b. To the Yonkers city school district there shall be  paid  seventeen
  million  five  hundred thousand dollars ($17,500,000) MULTIPLIED BY SUCH
  DISTRICT'S REGIONAL COST INDEX, PURSUANT TO SUBPARAGRAPH  TWO  OF  PARA-
  GRAPH  A  OF  SUBDIVISION FOUR OF SECTION THIRTY-SIX HUNDRED TWO OF THIS
  ARTICLE, on an annual basis.   Such grant shall be  payable  from  funds
  appropriated  for  such  purpose and shall be apportioned to the Yonkers
  city school district in accordance with the payment schedules  contained
  in  section  thirty-six  hundred nine-a of this article, notwithstanding
  any provision of law to the contrary.
    S 2. This act shall take effect immediately.
