BILL NUMBER:S3034 TITLE OF BILL: An act to amend the public authorities law and the New York state urban development corporation act, in relation to requiring organizations that receive funds for capital improvements by the New York state dormitory authority and the urban development corporation to use such funds for the purchase of energy star equipment and appliances where available PURPOSE: This bill requires any organization using capital improvement funds to purchase only Energy Star equipment and appliances. SUMMARY OF PROVISIONS: This legislation amends the public authorities law by adding a new section 1680-s, and amends section 1 of chapter 174 of the laws of 1968, the New York state urban development corporation act, by adding section 16-x. JUSTIFICATION: Although Energy Star products are generally slightly more expensive than non-compliant products, Energy Star products last longer and are more efficient over the life of the appliance. Non-energy star
products' efficiency levels decrease over the life of the machine, making these appliances more costly in the long run. Energy Star is a joint program of the U.S. Department of Energy and the Environmental Protection Agency created to provide information to consumers to allow them to make energy-efficient purchasing decisions. The Energy Star designation is given to products that are among the top 250 in terms of efficiency when compared with other products in their category. Estimates have shown that purchasing Energy Star products can reduce an average consumer's total energy cost by as much as one-third. Items purchased with capital improvement funds are responsible for a significant portion of energy consumption state wide. The universal adoption of Energy Star compliant products proposed in this bill will reduce long-term state spending on electricity and heating fuel while simultaneously reducing greenhouse gas emissions and the need for imported oil. The public authorities law is amended by adding a new section 1680-s to read as follows: S 1680-S. CAPITAL IMPROVEMENT FUNDING. 1. ANY FUNDS ADMINISTERED BY THE DORMITORY AUTHORITY TO AN ORGANIZATION FOR THE PURPOSES OF BUILDING UPGRADES, APPLIANCE PURCHASES, OR OTHER CAPITAL IMPROVEMENTS, SHALL BE USED TO PURCHASE ONLY ENERGY STAR EQUIPMENT AND APPLIANCES, WHERE AVAIL- ABLE. 2. FOR THE PURPOSES OF THIS SECTION, THE TERM "ENERGY STAR" SHALL MEAN A DESIGNATION FROM THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY OR DEPARTMENT OF ENERGY INDICATING THAT A PRODUCT MEETS THE ENERGY EFFI- CIENCY STANDARDS SET FORTH BY THE AGENCY FOR COMPLIANCE WITH THE ENERGY STAR PROGRAM. S 2. Section 1 of chapter 174 of the laws of 1968, constituting the New York state urban development corporation act, is amended by adding a new section 16-x to read as follows: S 16-X.
