TITLE OF BILL: An act to authorize the town of North Hempstead, county of Nassau, to convey to the Carle Place Water District, certain parklands

PURPOSE OR GENERAL IDEA OF BILL: To authorize the Town of North Hempstead to convey the Carle Place Water District certain park lands.

SUMMARY OF SPECIFIC PROVISIONS: Section 1. Authorizes the Town of North Hempstead town board to convey parklands located in the Carle Place Water District to the Carle Place Water District.

Section 2. States that authorization provided in section one shall be effective only upon the condition that North Hempstead dedicate an amount equal to or greater than the fair market value of the parklands being alienated.

Section 3. Describes the park lands being conveyed by North Hempstead.

Section 4. States that the conveyance of the parklands shall not occur until the town has complied with any federal requirements pertaining to the alienation or conversion of parklands.

Section 5. Effective date.

JUSTIFICATION: The Carle Place Water District needs to install a new well to better service the residents of Carle Place. There does not exists an abundance of land in the community which would suffice for the well. There is, however, land available at Fuschillo Park, a North Hempstead Town facility, that can accommodate the Water District's needs. As this land is actually in the parking lot, the effect to the park will be de minimis and the benefit to the community will be significant.

The Carle Place Water District has agreed to the following provisions:

1) will coordinate the construction staging and activities to minimize the disruption to the park and inconvenience to park goers.

2) The district will reconfigure the parking lot so there is no more than a two parking space loss.

3) The district will repave and restripe the parking lot at the end of the construction.

4) The improvement to the Well will be beneficial to the park as well as the surrounding community.

FISCAL IMPLICATIONS: None to the State.

EFFECTIVE DATE: This act shall take effect immediately.

MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to authorize the town of North Hempstead, county of Nassau, to convey to the Carle Place Water District, certain parklands THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The town of North Hempstead, county of Nassau, acting by and through its town board, is hereby authorized to convey by appropri- ate instruments to the Carle Place Water District, parklands located in the Carle Place Water District and described in section three of this act. S 2. The authorization provided in section one of this act shall be effective only upon the condition that the town of North Hempstead, county of Nassau, dedicate an amount equal to or greater than the fair market value of the parklands being alienated pursuant to section one of this act to the acquisition of new parklands and/or capital improvements to existing park and recreational facilities. S 3. The parklands to be conveyed by the town of North Hempstead, county of Nassau, pursuant to section one of this act are described as follows: All that certain plot, piece or parcel of land, situate, lying and being at Carle Place, Town of North Hempstead, County of Nassau and State of New York, said parcel being more particularly described as follows: BEGINNING at a point on the westerly line of Carle Road, said point being distant 320.08 feet northerly as measured along said westerly line of Carle Road from its intersection with the northerly line of Winnie Court; RUNNING THENCE South 78 degrees 35 minutes 15 seconds West 60.00 feet; RUNNING THENCE North 11 degrees 24 minutes 45 seconds West 27.12 feet;
RUNNING THENCE North 78 degrees 35 minutes 15 sections East 60.00 feet to the westerly line of Carle Road; RUNNING THENCE along said westerly line South 11 degrees 24 minutes 45 seconds East 27.12 feet to the point or place of beginning. Containing within said bounds 1,627.2 square feet more or less. S 4. The conveyance of the parklands authorized by the provisions of this act shall not occur until the town of North Hempstead, county of Nassau, has complied with any federal requirements pertaining to the alienation or conversion of parklands, including satisfying the secre- tary of the interior that the alienation or conversion complies with all conditions which the secretary of the interior deems necessary to assure that the substitution of other lands be equivalent in fair market value and recreational usefulness to the lands being alienated or converted. S 5. This act shall take effect immediately.
