BILL NUMBER:S3119 TITLE OF BILL: An act to amend the education law, in relation to requiring the commissioner of education to cause all schools to obtain written permission prior to collecting biometric information on pupils PURPOSE: The purpose of the legislation is to ensure the biometric information of students is not collected by schools without the prior written consent of their parents or guardians. SUMMARY OF PROVISIONS: Section one amends section 305 of the education law by adding a new subdivision 42, which provides the commissioner of education shall require all school districts and charter schools to obtain written consent from parents or guardians of pupils before collecting biometric information (i.e., intrinsic physical and/or behavioral information used for uniquely identifying individuals). Section 305 of the education law is amended by adding a new subdivision 43 to read as follows: 43. THE COMMISSIONER SHALL CAUSE ALL SCHOOL DISTRICTS AND CHARTER SCHOOLS TO OBTAIN WRITTEN PERMISSION FROM THE PARENTS OR GUARDIANS OF PUPILS IT INTENDS TO COLLECT BIOMETRIC INFORMATION ON PRIOR TO COLLECT- ING SUCH INFORMATION. SUCH SCHOOLS SHALL PROVIDE WRITTEN NOTICE TO THE PARENTS OR GUARDIANS OF PUPILS IT INTENDS TO COLLECT BIOMETRIC INFORMA- TION ON AT LEAST THIRTY DAYS PRIOR TO COLLECTION. THE WRITTEN NOTICE SHALL CONTAIN A STATEMENT INFORMING THE PARENT OR GUARDIAN THAT THEY MUST GIVE WRITTEN PERMISSION BEFORE A SCHOOL CAN COLLECT BIOMETRIC INFORMATION FROM THE PUPIL. THE COMMISSIONER SHALL PROMULGATE REGU- LATIONS NECESSARY TO IMPLEMENT THIS SUBDIVISION. S 2.
