BILL NUMBER:S3357 TITLE OF BILL: An act to amend the village law, in relation to including a high school member on village boards of trustees PURPOSE: To permit a village to have an ex-officio non-voting student member of its Board of Trustees SUMMARY OF PROVISIONS: This bill would amend Section 3-301 (1) (b) of the village law to provide for an ex-officio nonvoting student member of the village Board. The bill also adds a new section 3-305 to the Village Law which provides that a village may, subject to permissive referendum, appoint a local high school senior to a one year term. JUSTIFICATION The legislation is similar to legislation which allows students to be non voting members of school boards. The appointment would be a recognition by the community of its interest in student participation in local government. LEGISLATIVE HISTORY: 2010: S.5866/A.8940 FISCAL IMPLICATIONS: None. EFFECTIVE DATE: Immediately.

AN ACT to amend the village law, in relation to including a high school member on village boards of trustees
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Paragraph b of subdivision 1 of section 3-301 of the village law is amended to read as follows:
b. four trustees, except that the board of trustees of a village may change the number of trustees as authorized by section 3-304 of this article, AND EXCEPT THAT THE BOARD OF TRUSTEES OF A VILLAGE MAY APPOINT ONE EX OFFICIO STUDENT MEMBER TO SUCH BOARD AS AUTHORIZED BY SECTION 3-305 OF THIS ARTICLE;
S 2. The village law is amended by adding a new section 3-305 to read as follows:
S 3-305 EX OFFICIO STUDENT TRUSTEE. THE BOARD OF TRUSTEES BY RESOL UTION OR LOCAL LAW, SUBJECT TO PERMISSIVE REFERENDUM, MAY APPOINT ONE EX OFFICIO STUDENT MEMBER TO SUCH BOARD. SUCH STUDENT MEMBER SHALL BE A SENIOR IN A HIGH SCHOOL OF A SCHOOL DISTRICT IN WHICH ALL OR PART OF SUCH SCHOOL DISTRICT IS CONTAINED WITHIN SUCH VILLAGE. THE TERM OF SUCH STUDENT MEMBER SHALL BE FOR ONE YEAR AND SHALL BEGIN ON THE JULY FIRST PRECEDING THE SENIOR YEAR OF SUCH STUDENT MEMBER AND END THE FOLLOWING JUNE THIRTIETH. A VACANCY IN SUCH OFFICE MAY BE FILLED BY THE BOARD FOR THE REMAINDER OF SUCH TERM.
