TITLE OF BILL: An act to amend the education law, in relation to aid for coordinated collection development grants for public and non-profit independent colleges and universities

PURPOSE: This bill supports regional library resource sharing by modernizing the coordinated collection development aid (CCDA) formula in order to maintain the goals of quality and accessible scholarship among academic and research libraries and the public.

SUMMARY OF PROVISIONS: This bill amends Subdivision 5 of section 273 the education law. Section 1 updates the legislative findings pursuant to subdivision 5 indicating the intent to modernize the coordinated collection development aid formula. Section 2 amends subdivision (5) (b) (I) by itemizing the grant amount for each institution in the following manner; five thousand five hundred dollars in fiscal year 2010-2011, six thousand eight hundred seventyfive in fiscal year 2011-2012, eight thousand six hundred in fiscal year 2012-2013, ten thousand in fiscal year 2110-2014. Subdivision (5) (b) (2) is amended to award, to each institution, an additional one dollar and four cents for each full-time equivalent student enrolled in the academic year prior to state fiscal year 2011 and thereafter setting the rate at the level of the previous fiscal year indexed to any positive growth in the Consumer Price Index as set by the United States Bureau of Labor Statistics. Section 3 provides the effective date.

JUSTIFICATION: New York State Education Law establishes that public and private colleges and universities libraries receive state aid for the development of library collections. This program, known as coordinated collection development (CCD) is intended to promote the availability of critical information resources by supporting regionally coordinated collections that would be available through interlibrary loan. By helping academic libraries to build their collections in specific subject areas through annual grants. New York State ensures that the people of State have access to more and richer resources. Under a CCD program, regional clusters of higher education institutions would be spared the cost of individual purchases of select titles so long as one of the other collaborating institutions obtained that title. Coordinated reciprocity ensures the availability of titles. The State provides aid to these libraries for the purpose of improving access to resources in a coordinated manner. However, the formula directing state aid to public and private academic and research libraries has not been adjusted since 1954. During that time, prices of published academic materials has outpaced inflation, often rising at a rate of more than three times that of inflation. In 2009, total statewide funding for CCD did not reach $2 million for the more than 200 participating institutions. This program Deeds an adjustment in its formula if the goals of quality

and accessible scholarship are to be maintained. This program provides $1.04 for each full-time equivalent student and proportionate amounts for part-time or graduate students. By modestly revising the CCD funding formula to $1.50 per FTE with future increases indexed to changes in the consumer price index (CPI), New York State could ensure the viability of this withering program. Updating the CCD formula is needed to maintain the competitive advantages of New York's higher education sector. It also promotes a model of efficiency needed to combat the exponentially rising costs of books and other information resources.

FISCAL IMPLICATIONS: Each institution will receive five thousand five hundred dollars in fiscal year 2010-2011, six thousand eight hundred seventy-five in fiscal year 2011- 2012, eight thousand six hundred in fiscal year 2012-2013, and ten thousand in fiscal year 2110-2014. Additionally, one dollar and four cents will be granted to each institution for each full-time equivalent student enrolled in the academic year prior to state fiscal year 2011 and thereafter setting the rate at the level of the previous fiscal year indexed to any positive Growth in the Consumer Price Index as set by the United States Bureau of Labor Statistics.

Legislative findings. The formula directing state aid to public and private academic and research libraries has not been adjusted since 1984. During that time prices of published academic materials have outpaced inflation, often rising at a rate of more than three times that of inflation. The state provides aid to these libraries for the purpose of improving access and resources in a coordinated manner. This program needs an adjustment in its formula if the goals of quality and accessi- ble scholarship are to be maintained. Therefore, it is in the best interests of the state, its citizens and long-term academic and economic prospects to support modernization of the coordinated collection devel- opment aid (CCDA) formula. S 2. Subdivision 5 of section 273 of the education law, as amended by section 3 of part O of chapter 57 of the laws of 2005, is amended to read as follows: 5. Coordinated collection development program for public and nonprofit independent colleges and universities. a. Libraries of public and nonprofit independent colleges and univer- sities are entitled to receive annual funding for a coordinated collection development grant if they meet the following conditions: (1) Membership in a reference and research library resources system, (2) Their resources are made available to the public, through full participation in the interlibrary loan and other resource sharing programs of the reference and research library resources system of which they are members, and
(3) They meet the requirements set forth in regulations adopted by the commissioner including but not confined to (a) maintenance of effort, (b) relationships between reference and research library resources systems' programs and the regional higher education master plan, (c) submission of interlibrary loan statistics, and such other reports as may be required by the commissioner. b. Public and nonprofit independent colleges and universities with libraries which meet the criteria of paragraph a of this subdivision are eligible for annual grants as follows: (1) [Four thousand four hundred dollars for each institution] FIVE THOUSAND FIVE HUNDRED DOLLARS FOR EACH INSTITUTION IN FISCAL YEAR TWO THOUSAND ELEVEN--TWO THOUSAND TWELVE, SIX THOUSAND EIGHT HUNDRED SEVEN- TY-FIVE DOLLARS FOR EACH INSTITUTION IN FISCAL YEAR TWO THOUSAND TWELVE--TWO THOUSAND THIRTEEN, EIGHT THOUSAND SIX HUNDRED DOLLARS FOR EACH INSTITUTION IN FISCAL YEAR TWO THOUSAND THIRTEEN--TWO THOUSAND FOURTEEN, TEN THOUSAND DOLLARS FOR EACH INSTITUTION IN FISCAL YEAR TWO THOUSAND FOURTEEN--TWO THOUSAND FIFTEEN, and (2) One dollar and four cents for each full-time equivalent student enrolled in each qualifying institution, in the academic year completed prior to [the] state fiscal year TWO THOUSAND ELEVEN--TWO THOUSAND TWELVE. THEREAFTER THE RATE SHALL BE SET AT THE LEVEL OF THE PREVIOUS FISCAL YEAR INDEXED TO ANY POSITIVE GROWTH IN THE CONSUMER PRICE INDEX AS SET BY THE UNITED STATES BUREAU OF LABOR STATISTICS. For purposes of this section, a full-time equivalent shall be calculated as follows: (i) one full-time undergraduate student shall be considered one full- time equivalent student; (ii) one part-time undergraduate student shall be considered one-third of a full-time equivalent student; (iii) one part-time graduate student shall be considered one full-time equivalent student; and (iv) one full-time graduate student shall be considered one and one- half of a full-time equivalent student. c. Funds for the support of this program shall be appropriated to the department, except that funds for the state-operated institutions of the state university of New York and the senior colleges of the city univer- sity of New York, shall be appropriated to the state university of New York out of any moneys in the state treasury in the general fund to the credit of the state purposes fund not otherwise appropriated, and funds shall be appropriated to the city university of New York out of any moneys in the state treasury in the general fund to the credit of the local assistance fund not otherwise appropriated, and shall be subject to the same distribution formula as provided in paragraph b of this subdivision. S 3. This act shall take effect immediately.
