BILL NUMBER:S3446 TITLE OF BILL: An act to amend the public health law, in relation to opioid overdose prevention PURPOSE: To permit a school nurse who has been trained in an opioid overdose prevention program to administer an opioid antagonist to an overdose victim. SUMMARY OF PROVISIONS: Section 1 adds a new subdivision to section 3309 of the public health law to allow a school nurse having undertaken training in an opioid overdose prevention program approved pursuant to the public health law, may administer, either directly or indirectly, an opioid antagonist to an opioid antagonist recipient. Section 2 further amends section 3309 of the public health law, as amended by chapter 42 of the laws of 2014. to define "school nurse" as a person licensed or authorized to practice nursing pursuant to section 6905 of the education law EXISTING LAW:

MARCHIONE -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to opioid overdose prevention THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraphs (iii) and (iv) of paragraph (b) of subdivi- sion 3 of section 3309 of the public health law, as amended by chapter 42 of the laws of 2014, are renumbered subparagraphs (iv) and (v) and a new subparagraph (iii) is added to read as follows: (III) NOTWITHSTANDING ANY OTHER LAW, RULE OR REGULATION TO THE CONTRA- RY, A SCHOOL NURSE HAVING UNDERTAKEN TRAINING IN AN OPIOID OVERDOSE PREVENTION PROGRAM APPROVED PURSUANT TO SUBDIVISION ONE OF THIS SECTION MAY ADMINISTER, DIRECTLY OR INDIRECTLY, AN OPIOID ANTAGONIST TO AN OPIOID ANTAGONIST RECIPIENT. S 2. Subparagraph (iv) of paragraph (a) of subdivision 3 of section 3309 of the public health law, as amended by chapter 42 of the laws of 2014, is renumbered subparagraph (v) and a new subparagraph (iv) is added to read as follows: (IV) "SCHOOL NURSE" MEANS A PERSON LICENSED OR AUTHORIZED TO PRACTICE NURSING PURSUANT TO SECTION SIXTY-NINE HUNDRED FIVE OF THE EDUCATION LAW.
