BILL NUMBER:S3467 TITLE OF BILL: An act to authorize approval of certain transportation contracts of the Mamaroneck union free school district PURPOSE: To amend the education law, in reference to certain acts of the Mamaroneck Union Free School District regarding transportation contract for the 2008-2009 school year. The following contract was unfairly denied 1 and should be paid. The contract is C-412087 for the projected amount of $70,055 in 2008-09. SUMMARY OF PROVISIONS: Section � 1 ratifies the Education law in to legalize, validate, ratify and confirm notwithstanding any failure to comply with the contract award; Section � 2 directs the transportation aid as valid and proper. Section � 3 requires that this act shall take effect immediately. JUSTIFICATION: The Mamaroneck Union Free School District followed proper procedures for public notification regarding the awarding of transportation contracts for the 2008-2009. Unfortunately, the newspaper of record erred and did not publish the notification as per their agreement with the school district. The State Education Department denied the contract because the ad never appeared in the paper. In response, Mamaroneck provided receipts to SED demonstrating their intent to follow the proper procedures. SED would still not award the contract, This legislation is necessary to enable SED to award the contracts as the school district did act in full compliance with the required notice provisions. This legislation is required for the school district to receive the appropriate transportation aid as they would otherwise be entitled to under state law. AN ACT to authorize approval of certain transportation contracts of the
Mamaroneck union free school district
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. All the acts done and proceedings heretofore had and taken
or caused to be had and taken by the Mamaroneck union free school
district and by all officers, employees or agents of such school
district relating to or in connection with transportation contract
C-412087 of the 2008-2009 school year, and all acts incidental thereto
are hereby legalized, validated, ratified and confirmed, notwithstanding
any failure to comply with the contract award, approval, and filing
provisions of the education law, the general municipal law or any other
law or any other statutory authority, rule or regulations, other than
those filing provisions defined in paragraph a of subdivision 5 of
section 3604 of the education law, in relation to any omission, error,
defect, irregularity or illegality in such proceeding had and taken.
S 2. The education department is hereby directed to consider the
aforementioned contracts for transportation aid as valid and proper
obligations of the Mamaroneck union free school district.
S 3. This act shall take effect immediately.
