BILL NUMBER:S3480

TITLE OF BILL: An act to amend chapter 676 of the laws of 1978, amending the town law relating to payment in lieu of taxes for certain property in the town of Hempstead, in relation to extending the expiration thereof

PURPOSE: To preserve tax revenues for the City School District of the City of Long Beach and the Lido Beach and Point Lookout Fire District which would otherwise be lost as a result of the 1978 purchase of real property by the Town of Hempstead.

SUMMARY OF PROVISIONS: The bill authorizes and empowers the Town of Hempstead, which acquired property in Lido Beach, New York, for park and recreational purposes, to pay the taxing jurisdiction potentially affected by the loss of revenues, the amount of annual taxes last levied on the property. Payments will continue for five (5) additional years from 2013 to 2018.

JUSTIFICATION: The loss of revenue to the taxing jurisdictions (City School District of the City of Long Beach and Lido Beach and Point Lookout Fire Districts) would be substantial. The Town of Hempstead has agreed to hold these taxing jurisdictions harmless from losses for the next five (5) years.

LEGISLATIVE HISTORY: The provisions of this law have been extended every five (5) years since 1978, the latest being chapter 124 of the laws of 2008.

FISCAL IMPLICATIONS: None to the State.

EFFECTIVE DATE: Immediately
