TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to the issuance of distinctive plates bearing the words "Cure Parkinson's Disease", and to amend the state finance law, in relation to establishing the "Cure Parkinson's Disease Trust Fund"

PURPOSE:

To authorize the issuance of distinctive license plates bearing the words "Cure Parkinson's Disease," the proceeds of which, shall be used for Parkinson's Disease research.

SUMMARY OF PROVISIONS:

Section 1. Adds a new section 404-x to the vehicle and traffic law to authorize the creation of distinctive "Cure Parkinson's Disease" license plates. Requires an additional service charge of twenty-five dollars per license plate, twenty dollars of which shall be deposited to the credit of the cure Parkinson's Disease trust fund, to be used for childhood cancer research and education projects approved by the commissioner of health.

Section 2. Amends section 508 of the vehicle and traffic law, by adding a new subdivision 6, which directs the commissioner to develop license application and renewal forms, which shall solicit a voluntary one dollar donation from persons applying for, or renewing a driver's license at the time of such application or renewal. These donations shall be deposited in the cure Parkinson's Disease trust fund.

Section 3. Adds a new section to the 99-w to the state finance law to establish the Cure Parkinson's Disease trust fund.

JUSTIFICATION:

Parkinson's Disease is a chronic, progressive disorder of the central nervous system for which there is currently no cure. While there are a number of medications which help slow the progression, many of these medications lose their effects as the disease progresses making the need for a cure imperative.

This legislation furthers the goal of finding a cure for Parkinson's Disease by using the revenue generated by the "Cure Parkinson's Disease" license plates, as well as the donations elicited by the commissioner of the Department of Motor Vehicles, to be used for Parkinson's research and education projects.

The vehicle and traffic law is amended by adding a new section 404-x to read as follows: S 404-X. DISTINCTIVE "CURE PARKINSON'S DISEASE" LICENSE PLATES. 1. ANY PERSON RESIDING IN THIS STATE SHALL UPON REQUEST BE ISSUED A DISTINCTIVE LICENSE PLATE BEARING THE WORDS "CURE PARKINSON'S DISEASE". APPLICATION FOR SUCH LICENSE PLATE SHALL BE FILED WITH THE COMMISSIONER IN SUCH FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE. 2. ANY DISTINCTIVE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED IN THE SAME MANNER AS OTHER NUMBER PLATES UPON THE PAYMENT OF THE REGULAR REGISTRATION FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE PROVIDED, HOWEVER, THAT AN ADDITIONAL ANNUAL SERVICE CHARGE OF TWENTY-FIVE DOLLARS SHALL BE CHARGED FOR SUCH PLATE. TWENTY DOLLARS OF EACH SUCH TWENTY-FIVE DOLLAR ANNUAL SERVICE CHARGE SHALL BE DEPOSITED TO THE CREDIT OF THE CURE PARKINSON'S DISEASE TRUST FUND ESTABLISHED PURSU- ANT TO SECTION NINETY-NINE-W OF THE STATE FINANCE LAW AND SHALL BE USED BY NEW YORK STATE UNIVERSITY PARKINSON'S DISEASE RESEARCH HOSPITALS FOR RESEARCH AND EDUCATION PROGRAMS APPROVED BY THE COMMISSIONER OF HEALTH. PROVIDED, HOWEVER THAT ONE YEAR AFTER THIS SECTION SHALL TAKE EFFECT, FUNDS IN THE AMOUNT OF FIVE THOUSAND DOLLARS, OR SO MUCH THEREOF AS MAY
BE AVAILABLE, SHALL BE ALLOCATED TO THE DEPARTMENT TO OFFSET COSTS ASSO- CIATED WITH THE PRODUCTION OF SUCH LICENSE PLATES. S 2. Section 508 of the vehicle and traffic law is amended by adding a new subdivision 6 to read as follows: 6. THERE IS HEREBY ESTAB- LISHED IN THE JOINT CUSTODY OF THE COMMISSIONER OF TAXATION AND FINANCE AND THE COMPTROLLER, A SPECIAL FUND TO BE KNOWN AS THE "CURE PARKINSON'S DISEASE TRUST FUND". 2. SUCH FUND SHALL CONSIST OF ALL REVENUES RECEIVED PURSUANT TO THE PROVISIONS OF SECTION FOUR HUNDRED FOUR-X OF THE VEHICLE AND TRAFFIC LAW AND ALL OTHER MONEYS APPROPRIATED, CREDITED, OR TRANSFERRED THERETO FROM ANY OTHER FUND OR SOURCE PURSUANT TO LAW. NOTHING CONTAINED IN THIS SECTION SHALL PREVENT THE STATE FROM RECEIVING GRANTS, GIFTS OR BEQUESTS FOR THE PURPOSES OF THE FUND AS DEFINED IN THIS SECTION AND DEPOSITING THEM INTO THE FUND ACCORDING TO LAW. 3. MONIES OF THE FUND SHALL BE EXPENDED ONLY FOR PARKINSON'S DISEASE RESEARCH AND EDUCATION PROJECTS APPROVED BY THE COMMISSIONER OF HEALTH, OR TO PROVIDE GRANTS TO NEW YORK STATE UNIVERSITY PARKINSON'S DISEASE RESEARCH HOSPITALS FOR THE PURPOSE OF RESEARCHING AND PROMOTING A CURE FOR PARKINSON'S DISEASE. 4. MONIES SHALL BE PAYABLE FROM THE FUND ON THE AUDIT AND WARRANT OF THE COMPTROLLER ON VOUCHERS APPROVED AND CERTIFIED BY THE COMMISSIONER OF HEALTH. 5. TO THE EXTENT PRACTICABLE, THE COMMISSIONER OF HEALTH SHALL ENSURE THAT ALL MONIES RECEIVED DURING A FISCAL YEAR ARE EXPENDED PRIOR TO THE END OF THAT FISCAL YEAR. S 4. This act shall take effect on the one hundred eightieth day after it shall have become a law provided, however, that the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date is authorized to be made and completed on or before such date.
