TITLE OF BILL: An act to amend the criminal procedure law, in relation to designating uniformed court officers of the town of Marlborough as peace officers
PURPOSE: This bill designates uniformed town court officers in the Town of Marlborough as peace officers.
SUMMARY OF PROVISIONS:
Section 1: Amends Criminal Procedure Law section 2.10 by adding a new subdivision 84 to designate such town court officers as peace officers.
Section 2: Effective Date.
EXISTING LAW: Under current law such officers are not designated as peace officers.
JUSTIFICATION: This legislation would grant peace officer status to the uniformed court officers in the Town of Marlborough. This measure will enable the locality to save money. In addition, it will facilitate the many security services these officers provide. This legislation was requested by the Town of Marlborough. Similar legislation has been enacted to extend peace officer status to uniformed court officers employed by several local governments across the state.

EMPLOYEES OF THE TOWN COURT OF THE TOWN OF MARLBOROUGH SERVING AS UNIFORMED COURT OFFICERS AT SUCH COURT; PROVIDED, HOWEVER, THAT NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO AUTHORIZE SUCH OFFICER TO CARRY, POSSESS, REPAIR OR DISPOSE OF A FIREARM UNLESS THE APPROPRIATE LICENSE THEREFOR HAS BEEN ISSUED PURSUANT TO SECTION 400.00 OF THE PENAL LAW.
