BILL NUMBER:S3573 TITLE OF BILL: An act to amend the penal law, in relation to large capacity ammunition feeding devices PURPOSE: Makes all large capacity ammunition feeding devices, regardless of date of manufacture, subject to the provisions of the penal law. SUMMARY OF PROVISIONS: Section 1. Subdivision 23 of section 265.00 of the penal law as added by chapter 189 of the laws of 2000, is amended to read as follows: 23. "Large capacity ammunition feeding device" means a magazine, belt, drum, feed strip, or similar device, [manufactured after September thirteenth, nineteen hundred ninety-four], that has a capacity of, or that can be readily restored or converted to accept, more than ten rounds of ammunition; provided, however, that such term does not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rim-fire ammunition. � 2. This act shall take effect on the first of November next succeeding the date on which it shall have become a law. JUSTIFICATION: The law currently reads that these clips can be sold if they were manufactured before September thirteenth, nineteen hundred ninety-four. This bill closes the loophole that allows for the sale and ultimately the purchase of these high capacity devices that might be utilized in the same manner as those that have been banned. There are still certain parts of New York State where this type of ammunition can be purchased by buying the earlier dated devices, there is nothing stopping the conversion of these devices or even possibly the use of the earlier dated weapon. If we are going to safeguard our New York residents we should close all loopholes that allow for the sale of these devices no matter the date of manufacture. EXISTING LAW: New bill. FISCAL IMPLICATIONS: None. LOCAL FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall a take effect on the first of November next succeeding the date on which it shall have become a law.

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 23 of section 265.00 of the penal law, as added by chapter 189 of the laws of 2000, is amended to read as follows:
